The present dissertation investigates the strategic management of intellectual property as a crucial factor for the success of startups. The objective is to analyze how startups can optimize the protection and exploitation of their intellectual property assets from the conception of the idea, outlining the subsequent phases until the expansion of the business, in order to boost growth and competitive advantage, overcoming the legal challenges inherent to this business model. The study addresses the importance of the legal protection of intangible assets, such as patents, trademarks, copyrights, and trade secrets, to ensure legal certainty, minimize risks, and increase the chances of success for startups. The research also examines the different stages of startup structuring, from ideation to scale, highlighting the need for a proactive approach adapted to the dynamic and challenging reality of the market. Additionally, the dissertation explores the challenges faced by Brazilian startups in relation to the protection of intellectual property, emphasizing the importance of Complementary Law No. 167/2019 (Inova Simples) and Complementary Law No. 182/2021 (Legal Framework for Startups) as regulatory landmarks that seek to simplify and streamline the process of registration and protection of intellectual property for startups, in addition to fostering investment and innovation in the country. The research concludes that the strategic management of intellectual property is a fundamental pillar for the success of startups at all stages of their development, from the conception of the idea to consolidation in the market.
