Resumo: The present assignment does not have as its aim to wear out the topic, but to approach the position of the Supreme Court of Justice about the normative status of the intrinsic stipulations of the International Labour Organization that traverse on Humans Rights, as well as the doctrinaire regards on the topic. Determining the hierarchical baseline in which these labour stands are set is extremely important to establish the impacts that these international treaties may bring upon the legal system. The publication still aims at establishing the angle about which the Labour Laws pinpointes by International Labour Organization that can be considered as inborn human rights. Determining this aspect is a must to establish the range of the ius cogens standards of international law. Finally, we shall analyse the aspects concerning the control of convencionality and other impacts that intrinsic stipulations of the International Labour Organization can bring to the brazilian Labour Procedural Law.

Determinar o patamar hierárquico que se encontram essas normas trabalhistas é de suma importância para se estabelecer os impactos que tais tratados internacionais podem trazer sobre o ordenamento jurídico pátrio. A obra em questão pretende ainda estabelecer posicionamento sobre quais dos direitos trabalhistas apontados pela Organização Internacional do Trabalho podem ser considerados como de direitos humanos fundamentais. Determinar tal aspecto é imprescindível para se estabelecer o alcance das normas ius cogens do direito internacional. Por fim, analisaremos os aspectos relativos ao controle de convencionalidade e outros impactos que as Convenções fundamentais da Organização Internacional do Trabalho possam trazer ao Direito Processual do Trabalho brasileiro.Made available in DSpace on 2016-08-10T10:46:34Z (GMT).
