A judicialização como instrumento de garantia do direito à saúde: um estudo a partir da atuação da 6ª câmara cível do Tribunal de Justiça do Estado de Goiás, 2020/2021

The objective of this study is to analyze the scope of health direito through the investigation of judicial responses given to the demands of users of the Unified Health System (SUS), aiming to understand the dynamics of judicialization and its relationship with a guarantee of direito. And again, specifically contextualize public health in Brazil in its historical and political aspect; critically analyze the judicialization process of health in Brazil; uncover the profile of the judicial years of SUS users; identify the main types of lawsuits filed by SUS users in judicial processes in relation to health; and finally, analyze the decisions of the Judiciary in relation to the demands of SUS users in the 6th Câmara Cível of TJGO. The investigation guide was: How did the Judiciary respond to the judicial actions filed by SUS users in the 6th Civel Chamber (CC) of the Court of Justice of the State of Goiás (TJGO), aiming to ensure the guarantee of right? The method that guides research is historical-dialetic materialism that is a tool not only for analysis, but rather an instrument for the transformation of concrete reality. The bibliographical research is based on authors such as Bravo (2015), Paim (2008), Barcellos (2002), Behring (2006), Boschetti (2018), Bucci (2006), Costa et al. (2020), Mânica (2017), Lima (2017), among others. A documentary investigation shows how the proceedings of the Sixth Câmara Cível do TJGO, carried out during the years of 2020 and 2021. Based on the data presented, it is known that a great demand for judicial processes in search of access to medications, resulting in an overload of processes not judicial system. Faced with the obstacles faced and with the growing awareness of the citizens about their rights, many of us go daily to the Judiciary to guarantee the fulfillment of the rights assured in the Constitution of 1988, as a way of reducing the lack of time of the State in relation to the access to health services , especially not what he says, I respect the medications. The results of the investigation indicate a positive response from the 6th Civel Chamber in relation to the processes carried out, with all being deferred. However, the conclusion of this study highlights the failure to fulfill the constitutional requirement of universalization of health, which has led to increasing judicialization, as a consequence of the advancement of the privatization project in progress in Brazil.
