Resumo: This investigation focuses on the moment when human relationships that were once developed from a predominantly face-to-face associative life are increasingly being governed by machines, applications, social network, hardware, software, internet, cloud computing, deep learning, computer neural network, data, algorithms. The study on new technologies announces growing digital development, but also concerns about security in the collection, handling, processing, archiving and disposal of personal data, including sensitive data, which makes understanding the legal frameworks on data protection in Brazil essential, of the existence of the techno-regulation of Artificial Intelligence and consequently of frequent violations of fundamental rights. It is proposed through this study, a National Artificial Intelligence Policy in line with the founding principles of the State and built on the basis of the law, in its implementation through appropriate public policies and above all based on the revisiting of the human capacity to argue and resist, values that make us human and affect spheres of truth and justice inherent in the rule of law

O estudo sobre novas tecnologias anuncia crescente desenvolvimento digital, mas igualmente preocupações acerca da segurança na coleta, manipulação, tratamento, arquivamento e descarte de dados pessoais, inclusive dados sensíveis o que torna imprescindível a compreensão acerca dos marcos legais sobre proteção de dados no Brasil, da existência da tecnoregulamentação da Inteligência Artificial e consequentemente de frequentes ofensas aos direitos fundamentais.
