Resumo: On current days, the opening of public companies to private capital has gained prominence in privatization processes in various sectors of Brazilian activities, and is contrasted with strike movements by employees opposed to changing the legal nature of public companies subject to privatization. In this context, this paper seeks to analyze the legitimacy of strikes by employees of public companies against privatization. The methodology used in this dissertation was logical-deductive, through an analysis of the Federal Constitution, the Consolidation of Labor Laws and other infra-constitutional legislation pertaining to the subject, as well as the fundamental principles relating to the subject and court precedents of the superior courts. It appears that when the strike is mobilized against a decision by the public authorities, and due to foreign matter of the employment contract, the strike against privatization can be characterized as a political strike in the strict sense and, consequently, can be considered abusive on account of the reason that deflagrated it, which do not find legitimacy in the legal and constitutional parameters of the contemporary Brazilian legal system

Nesse cenário, esta dissertação busca analisar a legitimidade de greves de empregados de empresas públicas contrários às privatizações. A metodologia utilizada foi a lógico-dedutiva, por meio de análise da Constituição Federal, da Consolidação das Leis do Trabalho e demais normas infraconstitucionais atinentes ao tema, bem como dos princípios fundamentais atinentes ao tema e jurisprudência de tribunais superiores.
