This work aims to analyze mass incarceration in Brazil and its relationship with the abolition of slavery in Brazil. This liberating process of the black population (1888) was marked by negative attributes, as black people continue to be marginalized and discriminated against, and the Brazilian criminal justice system continues to be an instrument of repression and control of this population. The research built its core through qualitative methodology, using bibliographical references on the subject, mainly through scientific works by black scholars, but also with the quantitative method in comparing relevant statistical data about the Brazilian prison population – crimes, profile of those incarcerated, arrest in the act and custody hearing. The structure of the criminal justice system is one of the factors that explains the overcrowding of prisons by brown and black people. The STF recognized the Unconstitutional State of Affairs of the Brazilian prison system through ADPF 347, presenting the conditions of the Brazilian prison population as mass incarceration of the black population and violation of human rights, a reflection of structural racism in Brazil. Therefore, stigmatized abolition establishes a line of concept, function and examples in everyday life regarding the perception of black and brown people by the Brazilian penal system. The intersection of stigmatized abolition with racism and black Brazilian prison overcrowding is present to this day.
