This dissertation aims to examine TRIPS border measures within the Brazilian context and the legal parameters that delineate the customs authority's role in addressing the violation of intellectual property rights in the realm of international commerce. The study commences with an exploration of the customs' role and customs law in monitoring illicit cross-border goods, followed by an analysis of the legal framework of intellectual property within society and its protective mechanisms. Subsequently, the TRIPS Agreement is scrutinized, culminating in an investigation of the integration of TRIPS border measures into national legislation and their implementation by various customs units and federal courts across the country. A comprehensive understanding of this subject is essential to address the legal uncertainty arising from the current disparity in approaches and to establish measures and procedures that mitigate distortions and obstacles to international trade caused by the circulation of products infringing upon intellectual property rights.
