Resumo: This paper aims to analyze the process of the 1988's Magna Carta text constrution, underlining the constitutional debate between the two main ideologies in the country, developmentalist and liberal, particularly on issues of Constitution economic order. To this end, its fundament was the theory of the Austrian School of Economics, based on Friedrich August von Hayek. The study criticizes the thought of the legislators, specifically about the concepts of legal positivism, economic planning and social engineering, steeped in the constitutional text. In the first chapter there is a brief introduction of the origins and philosophical foundations of modern liberal constitutions until the twentieth century, when the concept of minimal and liberal Constitution will suffer a transformation. In the second chapter, there is a recapitulation of the historical context of the democratization process in Brazil, which resulted in the appeal of drawing up a new constitution. In the third chapter, ways of constitutional and referrals will be analyzed, from the choose of its process of text drafting to the way the work was conducted. Finally, the force idea of the Constitution writers was examined.

Finally, the force idea of the Constitution writers was examined.O presente trabalho tem como objetivo analisar o processo de elaboração do texto constitucional da Carta Magna de 1988, ressaltando o debate constituinte entre as duas principais correntes ideológicas existentes no país, desenvolvimentistas e liberais, especificamente nos temas da Ordem Econômica da Constituição. Para tanto, está fundamentado na teoria da Escola Austríaca de Economia, tendo por base as obras de Friedrich August Von Hayek. O estudo faz uma crítica ao pensamento dos constituintes, especificamente quanto aos conceitos de positivismo jurídico, planejamento econômico e engenharia social, impregnados no texto constitucional. No primeiro capítulo se faz uma breve introdução das origens e fundamentos filosóficos das Constituições liberais modernas até o século XX, quando a concepção de Constituição mínima e liberal vai passar por uma transformação. No segundo capítulo, faz-se uma recapitulação do contexto histórico do processo de redemocratização do Brasil, que culminou no apelo de elaboração de uma nova Carta Constitucional. No terceiro capítulo serão analisadas as formas e encaminhamentos da Constituinte, desde a escolha de como seria o processo de elaboração do texto até a forma como os trabalhos foram conduzidos.
