The study and the cultural property preservation emerged nationally in the 1930´s after the creation of IPHAN, a conservationist federal agency; however, in recent decades it has ocurred some changes and a deepening on the approach of this subject. In this new setting of establishment and implementation of public policies directed to the cultural property preservation, the promulgation of 1988 Constitution expresses the beginning of descentralization. Another item which has been contemplated by the new Constitution is the enlargement of the cultural heritage concept to include material and immaterial heritage as considered individually or together and as identity, action and memory reference bearer of the different groups which formed Brazilian community. The empowerment of the municipalities was important to the cultural heritage protection, promotion and management new setting. The municipalities became responsible, along with other national and state level agencies, for national, regional and local culture dissemination and preservation policy. The main objective of this study is to investigate the public policy formulation as well as the implementation directed toward to cultural heritage in the municipality of Sao Joao del-Rei (MG). Therefore, a qualitative case study was performed emphasizing managers views and perceptions on the chosen subject data was collected through semi structured interviews, non-participant observation and documentary research. Interviews were analysed through content analysis. At the end, it is possible to verify that the cultural heritage management in the municipality of Sao Joao del-Rei is still focused on the built heritage and on the intervention and control of the edification conservation. It is possible to underline this bias within Municipal Council of Cultural Heritage Preservation´s role which has been legally enlarged in its entitlement of validating historic heritage and edification conservation. After the Council was created more effective validation and control of the spaces and heritage buildings was performed. It is noticeable that cultural events are treated as peripheral factor in the cultural heritage public management in Sao Joao del-Rei, as secondary elements in the conservation policies. However, the municipality immaterial heritage is inherent to the locality and it has survived because it meant a lot to the community, once it is related to its history. It is a social local construction which supports the municipality´s diversity and cultural dynamics.
