Resumo: This research explores how and why the structure of judgments ruled by the Inter-American Court of Human Rights influences the binding force of these decisions. This research uses the case study methodology that allowed a careful systematization of the information obtained in the analysis of the sentences issued between 1987 and October 2017. The relevance of this study is mainly due to the fact that many of the remedies implemented in the Court's decisions influence (directly or indirectly) the public policies and agenda of the member states. In addition, this research allowed to identify and understand the alteration of the decisionmaking pattern of the inter-American judges by means of a proper methodology for collecting and analyzing the information obtained. The aim is to identify and explain the elements that have the greatest impact on the binding force of the Court's decisions, as well as to provide new hints for reflection on the rationality of inter-American judges and a proposal to adjust one of the stages of the process before this court.

Para poder chegar a essa compreensão, adotamos a metodologia de estudo de casos que permitiu a sistematização criteriosa das informações obtidas na análise das sentenças emitidas entre 1987 e outubro de 2017. A relevância desse estudo deve-se, principalmente, ao fato de que muitas das medidas de reparação implementadas nas decisões da Corte influenciam (direta ou indiretamente), as políticas e agenda públicas dos Estados membros. Além disso, essa pesquisa permitiu identificar e entender a alteração do padrão decisório dos juízes interamericanos por meio de uma metodologia própria para coleta e análise das informações obtidas.
