The present work has as thematic relevance the analysis of the phenomenon of globalization and the identification of the environment as a human right resulting from the cooperation of States in the international sphere. The development of society among the new technologies and modes of communication reflected the interconnection of countries and continents, providing not only the creation of a new global scenario, but the identification and demands of new social values that must integrate the daily lives of peoples. Looking at the process of economic development of the States, if on the one hand there is a human action for the satisfaction of material needs in the constant pursuit of profit, in contrast there are systematic reactions that dissipate in the global society characterizing the so-called “social risk” of the contemporary world. In the vision of the German sociologist Ulrich Beck, “risk” is characterized by a social force that resides in the threats to humanity now projected for the future, highlighting as paradigms environmental degradation and social inequality. In this respect, the production of risks affects not only the individual perpetrator, but all society as a whole, since its effects do not respect the frontier boundaries of the nation state, characterising, thus, the relativization of sovereignty. It is in this sense that, in the case of environmental problems, and in view of the international debates and conferences that have already dealt with the subject, highlighting the absence of limitation or territorial jurisdiction for their protection, from the Cooperative Constitutional State of Peter Häberle, there is a possible international aspect to the environment which is healthy and ecologically balanced, renewing the habits and values accorded to States and to society in general, founded on the duty of cooperation and the spirit of humanist solidarity, using as instrumental policies the International Conferences on the theme and the Consultative Opinion OC-23/17 on the environment and human rights
