Resumo: The present study is about an analysis of the right to health in Brazilian Constitution: complexities of a public-private relation in SUS. It begins, initially, from the evolution of the fundamental rights, necessary for the understanding of its dynamics, a look at the world historicity with the exploration of several legal documents produced throughout the times. It´s emphasized the constitutionalization phase, which will be characterized by the recognition of fundamental rights in positive law. It is relevant the historical and evolutionary analysis of the right to health in light of the Brazilian Constitutions and, especially, of the Constitution of the Republic of 1988. It passes through the principle of the dignity of the human person, since people's health is understood as a universal value to be sought by all. This paper highlights the supremacy of the Constitution and based on the Constitutional Text, describes and analyzes the Brazilian Health System in its complex public-private relation. In concrete terms, as an atmosphere of this relation, the underfunding of the SUS, the constant expansion of tax waivers in the health sector, which contribute to the strengthening of the private sector. The role of the National Supplementary Health Agency (ANS) in the regulation of health plan operators, as well as the role of reimbursement to the SUS, is also evaluated

Parte-se inicialmente da evolução dos direitos fundamentais, necessário para a compreensão de sua dinâmica, um olhar na historicidade mundial com a exploração de vários documentos legais produzidos ao longo dos tempos. Destaca-se a fase da constitucionalização que se caracterizará pelo reconhecimento dos direitos fundamentais no direito positivo. Faz-se relevante a análise histórica e evolutiva do direito à saúde à luz das Constituições brasileiras e, em especial, da Constituição da República de 1988. Passa-se pelo princípio da dignidade da pessoa humana, pois compreende-se a saúde das pessoas como valor universal a ser buscado por todos. Este trabalho destaca a supremacia da Constituição e com base no Texto Constitucional, descreve-se e analisa-se o Sistema de Saúde Brasileiro em sua complexa relação público-privada. Em termos concretos, como atmosfera dessa relação, o subfinanciamento do SUS, a constante ampliação das renúncias fiscais no setor da saúde, que contribuem para o fortalecimento do setor privado.
