Resumo: This work researchs Mediation from its characteristics, its cornerstones, and its use in the Brazilian Public Administration. The Mediation as an access to the legal order, through a dialog process with the research of its three structural cornerstones, without those it will not exist, process, participants and mediator, including the study of its agreement components of the Brazilian Mediation practices. In order to think about Mediation in Brazilian Public Administration it is necessary to study its elements because some of them is discussed when the Mediation is used. In order to do so, the study of Administrative Law is required because in the postmodernism its facing shifts from new trends, among others, the consensus, which started at the end of last century, when writers of the Administrative Law started to see its existence and its importance. The research shows the top of this trend is the Mediation Law, which has a chapter only in this area, in which the field of application is big. That is the reason why a systematization is necessary: The Mediation in, with and of the Brazilian Public Administration, which have different components that need attention in order to Mediation reach its objectives in this area

Será abordada a Mediação como acesso à ordem jurídica justa, por intermédio de um processo dialógico, com os seus três eixos estruturantes, sem os quais o instituto inexiste: processo, participantes e mediador. Nesse sentido, serão examinados os componentes contratuais verificados na sua prática no País. Para refletir sobre a Mediação e a Administração Pública, a análise envolverá os elementos a ela inerentes e sua utilização, uma vez que cada vez mais é debatida e intentada de forma regular ou irregular naquele contexto. Para tanto, adentra-se o estudo do Direito Administrativo, que, nos tempos da pós-modernidade, passa por uma mutação a partir de novas tendências, dentre as quais se destaca o consensualismo, que remonta ao final do século passado, quando autores da área passaram a identificar sua existência e, ao mesmo tempo, atribuir relevância a ele. A pesquisa aponta como ápice dessa tendência o Marco Legal da Mediação, que dedica um capítulo inteiro para a Administração Pública, na qual o espectro de utilização é muito amplo. Além disso, faz referência à importância de dispositivos do CPC que também tratam do tema.
