This paper aims at the theoretical and practical analysis of res judicata when it confronts the norms and principles of the Federal Constitution, with a focus on the possibility of its modification, flexibilization, relativization, deconstitution or its non compliance when the juridical decision that can no longer be appealed affronts the Magna Charta. The unconstitutionality of res judicata will be considered to exist whenever the court decision that terminates the process can no longer be appealed, but is nevertheless contrary to law, constitutional guarantee or principle, unfair, immoral, illegal, contrary to the reality of the facts, based on a law that was later declared unconstitutional by the abstract control of constitutionality and directly contrary to the Constitution itself. The confrontation existing between the defenders of the absolute character of res judicata will be verified vis-à-vis juridical security, and that of the defenders of the relativization of the institute, vis-à-vis the justice and supremacy of the Constitution. In addition to the identification of situations in which res judicata will be considered unconstitutional, the practical procedural mechanisms of control will be examined in the concrete case.
