Resumo: This paper analyzes the historical evolution of health and elderly standards, the influence of international events on Brazilian norms, the recognition of the right to health as a fundamental right, the Brazilian health system from the Federal Constitution of 1988, norms the protection of the elderly and their health. The effectiveness of norms for the protection of the rights of the elderly can be determined by indicators from the political matrix and its objectives
