Resumo: | This thesis is aimed to understand the process of “rualização” of children and adolescents, and to identify the reasons which favor the permanence of many of them in such situation until their adulthood, living on the streets and / or accessing the attendance and care services for homeless people. We contextualize our analysis from protection services to the homeless population of São José dos Campos / SP. The methodological organization of this research was built in several stages: bibliographic search, interviews with the subjects, and field research for compiling statistical data. This work is based on multiple sources of researches, within a perspective of the Complex Thinking, which allowed a greater apprehension of ideas, concrete facts concerning this multidimensional phenomenon. Besides a comprehensive bibliographic review, we also employed reference books, movies, music, including a history of the legislation concerning public policies aimed to protect children and adolescents, and the overall homeless population. Our research has also been devoted to the analysis of the National Social Assistance Policy (PNAS) and National Policy Inclusion of People on Homeless (PNPSR). The methodology used was quantitative and qualitative. For quantitative research, we employed data obtained from the Social Development Secretary (SDS), Municipal Health Secretary (SMS), Child Protection Council (TC) and the Bureau of Children and Youth (DIJU) of the municipality. Regarding the qualitative research, the focus was on the interviews with adults aged 19 to 40 who started the process of “rualização” in childhood or adolescence, but who still remain in the same condition, after twenty-five years of the implementation of the Child and Adolescent Statute (ECA). These adults interviewed have already been theoretically under the safeguards of some legislation, in particular under the Citizen Constitution (CF), the ECA. From the statistical data and oral reports it was possible to make a constructive critical analysis of the effectiveness of the social assistance law, social protection network and the existing structure in the city. Several failures involving the discontinuous data collection over the period of this study (2010-2015) could be noticed, as well as, the methodological flaws in the construction of sampling and gender. These facts show an imperfect description of this reality presented by the municipality in relation to the group of children and adolescents living on the streets and correspond to the reality presented by the records of the main body to identify and meet this demand – the Pop Center. This fact reinforced findings of previous studies about the difficulties of conducting research and the urgent need of municipal protection services to make proper use of statistical data, as well as the adoption of appropriate instruments to be deployed in the city. This study highlights the difficulties and limitations in the functioning of care services and protection to young people, based on current legislation, on population sampling methods and demonstrates. Contextualizamos nossa análise a partir dos serviços de proteção à população de rua do município de São José dos Campos-SP. A organização metodológica desta pesquisa foi edificada em várias etapas: levantamento bibliográfico, entrevistas com os sujeitos, e pesquisa de campo para o levantamento dos dados estatísticos. Este trabalho está ancorado em múltiplas fontes de pesquisa, dentro de uma perspectiva do Pensamento Complexo, o que permitiu uma maior apreensão das ideias e dos fatos concretos concernentes a esse fenômeno multidimensional. Servimo-nos de obras clássicas, filmes, músicas, documentos acadêmicos, incluindo um histórico de algumas legislações, políticas públicas direcionadas à proteção da criança e do adolescente e à população de rua em geral. Nossa pesquisa foi também voltada para análises na Política Nacional de Assistência Social (PNAS) e na Política Nacional de Inclusão da Pessoa em Situação de Rua (PNPSR). A metodologia utilizada foi de natureza quanti-qualitativa. Para a pesquisa quantitativa, valemo-nos de dados obtidos junto à Secretaria de Desenvolvimento Social (SDS), Secretaria Municipal de Saúde (SMS), Conselho Tutelar (CT) e Delegacia de Infância e Juventude (DIJU) do município. Em relação à pesquisa qualitativa, nosso foco foi o depoimento de adultos, com a faixa etária entre 19 e 40 anos de idade, que iniciaram o processo de rualização na infância ou adolescência, mas que ainda permanecem nessa condição, após vinte e seis anos da implantação do Estatuto da Criança e dos Adolescentes (ECA). Esses adultos entrevistados, já estariam, teoricamente, sob as salvaguardas de algumas legislações, em especial da Constituição Federal (CF) e do ECA. A partir dos dados estatísticos e dos relatos orais, foi possível uma análise crítica construtiva da efetividade da legislação da Assistência Social, da rede de proteção social e do aparelhamento existente no município. Pudemos constatar várias falhas envolvendo a coleta descontínua de dados ao longo do período desta pesquisa (2010 a 2015), além de equívocos metodológicos na construção da amostragem e de gênero. Tais fatos mostram uma descrição imperfeita da realidade apresentada pelo município em relação ao grupo de crianças e adolescentes que vivem nas ruas e correspondem àquela apresentada pelos registros do órgão principal responsável por identificar e atender esta demanda: o Centro Pop. Essa constatação reforçou conclusões de estudos prévios sobre as dificuldades de se realizar pesquisas e da necessidade imperiosa dos serviços municipais de proteção de fazerem uso adequado dos dados estatísticos, assim como da adoção de instrumentos apropriados a serem implantados no município. Assim, este trabalho realça as dificuldades e limitações no funcionamento dos serviços de atendimento e proteção aos jovens, embasados nas legislações vigentes e nos métodos de amostragem dessa população.
