Resumo: | The purpose of the study is to examine the structure and organization of the civil process and the various models or types of structure that can be formed from culture. From the insertion of law as a product of social adaption, it was sought to demonstrate that since procedural law is the branch closest to life, culture is not infamous. In the first part examines the origin and evolution of the dispositive principle in order to reach its real content and contemporary extension. In order to achieve this, the content of its opposite principle (the inquisitorial) was drawn from its construction in criminal law. Firstly, the division of the dispositive principle and the debate of the German doctrine of the eight hundred is exposed, and its content and extension are limited. Already in the second part of the thesis, based on the premises established in the first one, the two most well-known models of organization of the civil process are presented, namely the adversarial model, the Reactive States and the social model (non-adversarial), drawing their differences from historical and political factors. The ideological debate that over the last decade formed these two systems is still presented and surpassed today. Before closing this part of the study, other possible organizational models are seen from historical experience. Countries of socialist economy; and the so-called cooperative model of civil procedure. Finally, in the last part of the study, the division and classification of individual and transindividual rights is exposed in order to demonstrate the inapplicability of the principle of demand (or dependence on the will of the interested party) to the latter. From the universalization of procedural conventions in the CPC of 2015, the political-legislative option of granting greater autonomy to the parties in some types of litigation is highlighted, with a reading of art. 370 of the CPC, which provides the power to determine ex official evidence by the judge to only focus on cases where there are no fully capable parties or litigation over rights that do not allow self-determination, or even when the parties are not in a situation of Negotiating parity. |

A partire dalla inserzione del diritto come un prodotto di adattamento sociale, si ha cercato di dimostrare che, essendo il diritto processuale il ramo pi? prossimo alla vita, non ? questo opposto alla cultura, anzi al contrario. Nella prima parte ? controllata l?origine e evoluzione del principio dispositivo affinch? si raggiunga il suo vero contenuto ed estensione nella contemporaneit?. Per raggiungere questo scopo ? stato tracciato il contenuto del suo principio opposto (l?inquisitorio), a partire dalla sua costruzione nel diritto penale. Ancora nella prima parte, ? esposta la divisione del principio del dispositivo e della trattazione nella dottrina tedesca dell?800 e delimitato il suo contenuto ed estensione. Gi? nella seconda parte del lavoro, a partire dalle premesse stabilite nella prima, sono presentati tutti i due pi? conosciuti modelli di organizzazione del processo civile, ossia il modello avversariale, degli Stati Reattivi ed il modello sociale (non avversariale), degli Stati Attivi, tracciando le loro differenze a partire dai fattori storici e politici. Ancora ? presentato e superato il dibattito ideologico che, nei ultimi decenni, si ? formato a lungo di questi due sistemi. Prima di chiudere questa parte dello studio sono presentati altri possibili modelli organizzazionali: il primo, visto, come esperienza storica, nei Paesi di economia socialista; ed, il secondo, o chiamato modello cooperativo di processo civile. Infine, nell?ultima parte dello studio, ? esposta la divisione e la classifica dei diritti individuali e collettivi, con lo scopo di dimostrare l?innaplicabilit? del principio della demanda (o della dipendenza della tutela a seconda dell?interessato) agli ultimi. A partire della universalizzazione delle convenzioni processual nel CPC (Codice Processuale Civile) del 2015, si mette in evidenza l?opzione politica legislativa di concedere maggior autonomia alle parti in alcuni speci di letigi, facendosi una lettura dell? articolo 370, del CPC, il quale prevede il potere di determinazione di prova d?ufficio dal giudicatore in incidire soltanto su processi in cui non attuino parti pienamente capaci o in litigi sui diritti che non permettano autocomposizione, o, inoltre che le parti non stiano in situazione di parit? negoziale.O estudo tem por objeto o exame da estrutura e a organiza??o do processo civil e dos variados modelos ou esp?cies de estrutura que podem se formar a partir da cultura. A partir da inser??o do direito como um produto de adapta??o social, procurou-se demonstrar que, sendo o direito processual o ramo mais rente ? vida, n?o ? ele infenso a cultura, muito antes pelo contr?rio. Na primeira parte ? examinada a origem e evolu??o do princ?pio dispositivo a fim de alcan?ar seu real conte?do e extens?o na contemporaneidade. Para alcan?ar esse objetivo foi tra?ado o conte?do de seu princ?pio oposto (o inquisit?rio), a partir de sua constru??o no direito penal. Ainda na primeira parte, ? exposta a divis?o do princ?pio do dispositivo e do debate na doutrina alem? dos oitocentos e delimitado seu conte?do e extens?o. J? na segunda parte do trabalho, a partir das premissas estabelecidas na primeira, s?o apresentados os dois mais conhecidos modelos de organiza??o do processo civil, quais sejam o modelo adversarial, dos Estados Reativos e o modelo social (n?o-adversarial), dos Estados Ativos, tra?ando suas diferen?as a partir de fatores hist?ricos e pol?ticos. Ainda ? apresentado e superado o debate ideol?gico que, nas ?ltimas d?cadas, se formou ao longo destes dois sistemas. Antes de encerrar esta parte do estudo s?o apresentados outros poss?veis modelos organizacionais: o primeiro, visto, como experi?ncia hist?rica, nos pa?ses de economia socialista; e, o segundo, o chamado modelo cooperativo de processo civil. Por fim, na ?ltima parte do estudo, ? exposta a divis?o e classifica??o dos direitos individuais e transindividuais a fim de demonstrar a inaplicabilidade do princ?pio da demanda (ou da depend?ncia da tutela ? vontade do interessado) aos ?ltimos.
