Resumo: The present is about a study of manifestation of the Ombudsman of Health in the County of Maringá and it has the purpose to verify, from the documental research, if it fulfills it´s role, while the mechanism of participation and social control. For this, the yearly reports of the Ombudsman and the accounts of the City County of Health of the period understood between 2003 to 2014 were analyzed. We seek, with base in data analysis, to outline an overview of the Ombudsmans actions and, from the demands, understand to what point it is being effective. The results of this study revealed that the Ombudsman was effective, that is, it showed to fulfill it´s role, while receiving the treatment of citizens manifestations, in a timely fashion. On the other hand, it was not effective in relation to the most of the demands collectively, that´s why it sub used the data e information brought by the demonstrators, and as it also did disclose the management reports, actions and services in a satisfactory manner to the City Council of Health and other instances of social control as well as the population. The data also denotes that the Ombudsman was not effective in establishing dialogue with one of it´s main partners in social control, showing how insufficient the intercommunication with the City Council was, pointing a subordinate role to the interests of managers over the protesters, incurring the lack of transparency and accountability drive. Resonated, this way, in actions and interventions such as isolated as palliative, by part of the public leaders, which prevented possible changes and implementations in the politics of health, as an answer to the needs of the population

Para isso, foram analisados os relatórios anuais da ouvidoria e as atas das reuniões do Conselho Municipal de Saúde do período compreendido entre 2003 a 2014. Buscamos, com base na análise dos dados, delinear um panorama das ações da ouvidoria e, a partir das demandas, entender até que ponto ela está sendo efetiva. Os resultados deste estudo revelaram que a ouvidoria foi efetiva, isto é, ela demonstrou cumprir com o seu papel, quanto ao recebimento e tratamento das manifestações dos cidadãos, de forma pontual. Por outro lado, não foi efetiva em relação à maior parte das demandas de forma coletiva, isso porque subutilizou os dados e as informações trazidas pelos manifestantes, como também não divulgou os relatórios gerenciais, ações e serviços, de forma satisfatória, para o Conselho Municipal de Saúde e para outras instâncias de controle social como também para a população. Os dados também denotam que a ouvidoria não foi efetiva no estabelecimento do diálogo com um dos seus principais parceiros no controle social, mostrando o quanto foi insuficiente a intercomunicação com o conselho municipal, apontando uma atuação subordinada aos interesses dos gestores em detrimento aos manifestantes, incorrendo na falta de transparência e no acionamento da accountability.
