CRIMINALIDADE PRATICADA POR ADOLESCENTES E POLÍTICAS PÚBLICAS DE REINSERÇÃO SOCIAL: um estudo de caso na Comarca de Guarabira

The present researched had as its study object the criminality practiced by teenagers at Guarabira Judicial District. It was searched to investigate the causes that make the teenagers commit crimes; to identify the classification of the most common crimes as well as to outline the social and aconomical profile of the transgressor teenagers. It was made a study about the current public policies towards transgressor teenagers, searching to analyze their effectiveness in the criminality reduction, implemented by governamental or non-governamental agencies. It was also analyzed the applicable legislation for trangressive acts pratised by teenagers such as the children and teenagers Statute ande the Brazilian Penal Code, making a historical and judicial analysis. The research was performed at the Tutor Counsel in Guarabira and at the Second Court of Guarabira Judicial District, which is restricted for Childhood and Adolescence. The data were collected by consulting the trangressive acts register practiced by adolescents at the Tutor Counsel in Guarabira, as well as resulted from the Computed System of Paraiba Law Court SISCOM, taking as parameter the last five years. It was made an initial historical analysis of the transgressor adolescent legislation and his penal responsibility. It was emphasized the polemic about the full penal age reduction, a very interesting and actual theme for discussion motivated by the media, by the society and by the Parliament caused by the death of the six-year-old boy João Hélio Fernandes Vieites who was fiercely dragged by a car during fifteen minutes by criminals, among them there was an adolescent. The collect data of the research revealed that the majority of transgressor adolescents come from poor social class, with low education level and they crimes are recidivative. It was also demonstrated that crimes practiced by teenagers are, in their majority, against property and involve drugs. Concerning the public policies towards the teenager social reinsertion, their ineffectiveness was evident, both in governamental and in non-governamental levels, that is the cause of the high level of recidivation.
