This dissertation seeks to establish a certain relationship between analyzes in the field of economic, law and the social. Therefore, works through the operaism and post-operaism and also Foucault's productions, with the purpose to draw a transition from modernity to contemporaneity from the perspectives of the policy on production and economic exploitation and of the legal and political functioning of institutions. The theoretical path begins with the analysis of economic production, analyzing the transformation of movements and struggles inside the Welfare State to the neoliberal and financial government in their features and settings of exploitation and domination. Then, pass through the same path, but with the lens of the analysis of the functioning of the legal and political institutions, also analyzing the difficulties and changes driven by organizations from the society, which would transform to the centrality of the welfare state, with the constitutionalization of work, to forms of dispersed control in neoliberalism and governance. Finally, the last chapter is dedicated to the setting of biopolitical production as an open field of fights and in multitudinous construction of new institutions, which runs through the economy, the law and would enter in the whole society, as well as the aporias that this struggles find today.
