The present work the use of the social role of women as an element to legitimate the juridical inequality the differences between the sexes within the first decades of the XX century when, as a consequence of the republican modernization, distinct law fields were codified, such as civil or election law. The social function is a concept in consonance with the intellectual production oriented by the natural sciences perspective that conceived the social analysis from the perspective of the application of exact patterns and general laws. The idea of the law as a function, idea defended specially in France, was included and gained a new focus in Brazil, where the social function was used as the concept used to set the place and role of the individuals from each sex should occupy and play, aiming the progress. The social function is defined by the characteristics and inclinations innate to each sex. The sharing of the organicist and positivist ideas from different philosophies explains the use of this notion by groups so different as the conservatives, the Catholics, the masons or the feminists. Every school of thought wants to break-down the concept to form the image of women that is better for its view on society. The formation of the republican structures, including the conformation of the law, shows the scenery of dispute, the transition of comprehension in the social role of women, that allow the coexistence of the example of Mary and the sensuality and independence of the modern woman. The social role of the wife and mother is not refuted by the conservative men in the parliament and neither through the newspapers and magazines by the groups that defend the women s rights. The concept of social role reinforces the modern law in Brazil, in which the feminists and theirs supporters intend to insert also the female sex
