This work aims to examine the functional qualification, the main contours and the limits of autonomous guarantees in Brazilian law. The institute demonstrates as peculiar trait the autonomy it presents in relation to the guaranteed obligation, and it is increasingly present in a global dimension, arising from the complexity of commercial, banking and business relations. Considering the contractual freedom and private autonomy in the scope of obligations, which allows the parties to adjust atypical arrangements in order to regulate their centers of interests, the creation of a new type of guarantee is understood as plausible, conditioned to the compatibility of their function with the values of the legal system. In a panorama of traditional guarantee modalities that prove to be insufficient, it is proposed that, although atypical, autonomous guarantees should be studied from a functional perspective, which will enable their applicability in concrete, in the light of the constitutionalization of the legal system. Starting from its functional profile, using the civil-constitutional methodology, the work aims to delineate guidelines about the contours of the autonomous guarantees, which allow to assist the interpreter in the face of this type of negotiation arrangement, even in the absence of specific legislation in the Brazilian system. From the legal-theoretical method, based on doctrinal and jurisprudential research, will intend to go through the study of the theme, starting from a qualitative-functional examination, in order to identify the role of the autonomous guarantee in the system of credit guarantees. This analysis justifies a comparative examination between autonomous guarantees and similar figures. The legal relations that contribute to the creation of the guarantee will also be a subject of study, as well as the execution system and the limits of the autonomous guarantees.
