This work turns to the study of advance directives about the end of life in the physician-patient relationship in Brazil. It is intended to verify the bioethics legitimacy and the legitimacy and legal possibility practice of advance directives about the end of life as a central goal. The aim is to assess the suitability, bioethics and legal, of advance directives as a vehicle for personal self-determination over its existential possibilities and formulating his plan of life - and death - worthy. Moreover, specifically, it seeks to determine the legal possibility of advance directives in the Brazilian Planning: consistency with constitutional guarantees and the existence of institutions to fit the practice. It is proposed to maintain the legal legitimacy of advance directives in Brazil, indicating possible paths to solutions interpretation in legal terms, and the effects on medical relationship from also bioethical considerations. It is intend to verify the compatibility between the ethical standards of bioethics origin and the legal rules of constitutional status protection to the human person. The thesis also proposes the analysis of the context in which advance directives are used to (i) discuss the of 'capacity' ideas and 'competence' to practice this act of personal autonomy, (ii) discuss how the family perspective, technical perspective of health professionals and the prospect of the Judiciary limit freedom of this act and (iii) assess the effectiveness of these acts in the clinical and family space. Therefore, study will be undertaken by theoretical literature and references, which will raise the publications, national and international, on the subject of the thesis. The literature comprise preferably works on philosophy, ethics, bioethics and law, allowing the analysis of theoretical issues involved in the study. The development work is divided into three chapters. The first would establish the conceptual basis and the legal grounds of advance directives. The second chapter presents the systematization of the bioethical and legal values that relate to the practice. Chapter three will make appropriate fundamental questions the validity and effectiveness of the practice of advance directives in Brazil. From the assumptions built throughout the development, research the outcome intends to strengthen his central argument demonstrating then bioethics legitimacy and the legitimacy and the legal possibility of advance directives about the end of life in the current Brazilian context
