The aim of this dissertation is to present an articulation between Psychoanalysis and Law, considering the possibilities and difficulties found by the professional with psychoanalytic formation that works on the Sector of Penalties and Alternative Sentences in the judicial system, when dealing with people who committed crimes considered to be without serious threat to people. We noted that the fundamentals of culpability and the theories that justify the punishment prioritize the conscience of the illicit acts, which points to a logic that we call the supremacy of the conscious. We point out that the supposition of the subject of the unconscious, a subject who insists, can offer a counterpoint to the logic pointed out and enable the inclusion of this subject. Our hypothesis - based on working with people under alternative penalties and on the contributions of Freud and Lacan - is about the possibility of being offered moments of listening in which there may be opportunities for some elaboration by those who committed the crime in relation to the act considered criminal. We believe that listening to the psychoanalyst can make something of the singularity emerge, allowing, in some cases, conditions for some symbolization of the act by the word and the subjective assent of the sentence. Psychoanalysis, structured from the discovery of unconscious psychic determination, can be a way of contributing to a work implied with subjective responsibility in the judiciary sphere
