Resumo: | It is clear that the development of artificial intelligence has given society facilities, however, the lack of understanding of its operation results in its opacity, which is aggravated by the tracking of its users' data, resulting in varied risks that can influence several areas of personality, especially privacy. This study aimed to investigate the role of international law in the regulation of artificial intelligence in the transnational scenario, in order to protect human rights, specifically privacy in the services offered on the Internet. It is worth asking: how could the right of people be relevant in the face of the risks presented by the progress of artificial intelligence together with intensive data processing in the use of online features? Methodologically, the research is based on the deductive and exploratory character, and the conceptual-theoretical methodological proposal.Thus, in the first part, under a general aspect, the opacity of the digital age is exposed, with the presentation: of the algorithm, artificial intelligence and its risks, relating them to big data and search systems. In view of this scenario, the violation of privacy is alerted, highlighting its relevance, the failure to anonymize data, culminating in the need to regulate autonomous systems. In the second part, it focuses on the feasibility of regulation at the international level, considering the existence of a global administrative space; passing through the debate of unity, fragmentation and the international law; to then highlight the existence of self-regulation - as a result of the convergence of the public with the private -, which is exercised by transnational companies and, more specifically, by technology corporations; which can take place under the format of techno-regulation – regulation by technology itself. In the third part, in order to avoid the empire of regulation by the algorithm – which tends to favor business interests and reduce privacy protection -, the Human Rights Structure is presented – seen from the perspective of the universal law of humanity - as a guiding thread that should permeate commercial relations, more specifically those that occur on the Internet and, especially, support the regulatory treatment of artificial intelligence in a transnational way. Finally, in the fourth part, in order to give greater concreteness to the regulatory proposal, it is presented the indispensability of the meta-technological perspective in international law - based on the Human Rights Structure –, so that computer systems must have, as a development premise, the principle of human rights by design, which does not prevent the concomitant existence of other ways of shaping technology, in order to give greater protection to human rights and, notably, privacy. |

O presente trabalho pretendeu investigar o papel do direito internacional na regulação da inteligência artificial no cenário transnacional, de modo a se tutelar os direitos humanos, especificamente a privacidade nos serviços ofertados na Internet. Cabe indagar: como poderia o direito das gentes ser relevante diante dos riscos apresentados pelo progresso da inteligência artificial junto ao tratamento de dados intensivo na utilização das funcionalidades online? Metodologicamente, a pesquisa tem por base o caráter dedutivo e exploratório, sendo a proposta metodológica conceitual-teórica. Assim, na primeira parte, sob um aspecto geral, expõe-se a opacidade da era digital, com a apresentação: do algoritmo, da inteligência artificial e seus riscos, relacionando-os com o big data e os sistemas de busca. Diante desse cenário, alerta-se a vulneração à privacidade, destacando a sua relevância, a falha na anonimização de dados, culminando com a necessidade de se regular os sistemas inteligentes. Na segunda parte, foca-se na viabilidade da regulação no âmbito internacional, considerando a existência de um espaço administrativo global; perpassando pelo debate da unidade, fragmentação e o direito das gentes; para então destacar a existência da autorregulação - como resultado da convergência do público com o privado -, sendo essa exercida pelas empresas transnacionais e, mais especificamente, pelas corporações de tecnologia; podendo se dar sob o formato da tecnorregulação – regulação pela própria tecnologia. Na terceira parte, de modo a se evitar o império da regulação pelo algoritmo – que tende a favorecer os interesses empresariais e reduzir a proteção à privacidade -, apresenta-se a Estrutura de Direitos Humanos – vista sob a perspectiva do direito universal da humanidade -, como fio condutor que deve permear as relações comerciais, mais especificamente as que ocorrem na Internet e, especialmente, fundamentar o tratamento regulatório da inteligência artificial de forma transnacional.
