This work discusses the relationships between the society and the State in Brazil starting from the access of the population to the state instances of resolution of conflicts. The changes happened in Brazil in the last years of the century XIX and in the f irst decades of the XX they brought to the surface many subjects that showed and they were expressed in different ways. To the social and political movements, the lawsuits are added that were moved in search of solutions to daily subjects and expressing the politicization of political behavior of a portion of the population. The research was delimited by the years of 1890 and 1916. It is treated, respectively, of the dates of approval of the republican Penal and Civilian codes. Those marks translate two important moments of the legal production in the new government way established in 1889 and, in this period, laws and ordinances were implemented organizing and institutionalizing the republican State and their judicial instances. The city of Rio de Janeiro, the republican government's headquarters, was the privileged place for the analysis of the actions and social and political movements. It is the most important city of the period, the more densely populated and with social characteristics quite diversified, and converge on her political attention and major bureaucratic structures of republican government The study was accomplished through the analysis of the legislation that organized the federal Judiciary Power, the federal district, defined the rules and the right norms and, fundamentally, of the group of the lawsuits petitioned in the period by the population of the capital of the republic. Finally, it is ended that the access to the justice, on those republican years, was one of the roads found for the search by rights and for solutions for the problems faced in the daily. That if it differentiated in the other ways of political participation for happening inside of the system starting from the structures of the State, but that, it was treated of a limited process by the inherent characteristics to a society unequal, excluding and authoritarian.
