Economic crimes are distinguished by the high degree of evidentiary intricacy that they entail. It is the purpose of this work to investigate the use of leniency agreements as a device capable of assisting in evidentiary instruction by taking advantage of the willingness of the firms to cooperate with criminal investigations arising from certain incentives. As a result of the work, it was demonstrated that it is necessary to regulate the practice of accepting the adhesion of the individuals involved to leniency agreements, which is a practice that has already been established by the Federal Prosecutor´s Office. Current legislation presents shortcomings that contribute to legal uncertainty and, as a result, discourage businesses from cooperating fully with investigators. This work discusses numerous facets of internal investigations, as well as the requirements for them to provide evidence that can be utilized in criminal proceedings. Through the analysis of the leniency agreements, means of deepening the integration of enterprise compliance systems with criminal proceedings are evaluated, seeking to contribute to the development of a legal framework for corporate investigation that protects the rights of whistleblowers, employees, and other stakeholders, while facilitating the use of corporate investigation in criminal proceedings.
