Relações de emprego no campo: as diversas formas de contratação produtiva

Resumo: | This is a dissertation wich main focus is the study, in the state of Goiás, of the employments relations in the field and its relateds.The disrespect to the workers rigths in the field has been perpetuated through the years. Only after the brasilian Constitution of 1988, rural and urban workers received the same legal treatment. The slavery that has been present for more than three hundred years can still be found through work practices that look like it.The arrival of the capitalist relations to rural area brougth more damage to the condition of the rural worker. The employment relation is a specie of the work relation itself and, to better contextualize it as a kind of subordinate service installment, different from the autonomous work and of other forms of subordinate service contribution, it is described the juridical discipline of the rural employment contract and of this other forms of service installment. In the last years, it was edited two laws creating specific rules to discipline the bond of rural employment. Both of them came from the fact that the demand of labor in the, nowadays, occurs in specific steps of production. The increase of productivity, caused by the modernization of agrarian activities raises the efficience of the system, but reduces the creation of employment. It does not necessarily implies the increase of work posts. Therefore, the biggest problem faced today, related to the emloyment in the rural area, is the bóia fria employee. Miguel Reale s Three dimension theory of Rigth sees the rigth as a normative integration of fact according to values. It allows an explainable analises of the rural employment problems, containing the elucidation of the conditions that came from the historical process and from the productive recovering, to, in the next step, analise the work law undestood in its three meanings: fact, value and norm, based in the constitutional principles of social function of the rural land and the dignity of human been. At the end, it is concluded that the question of work in the field goes far away from the work area. It depends of cultural changes and of the land distribution. Without a vision of the employee as a dignous human been, wich implies the fullfielment of the social function of the land, and without a better distribution of it, it is not possible to solve this problem. At last, it is analised the perspectives that shows themselves to the rural employees in Goiás. This dissertation is built up in three chapters. The first one, in which is related the history of Brasil and Goiás and a study about the production ways in this period. The second one, when the services types autonomous and subordinate - are characterized and is described the legal and judicial treatment, due to the expenditure of labor, in the various ways in which it is presented, focusing on the work of rural employees. The third chapter, in which is analyzed the situation of the rural employee, focusing the rural employee in Goiás, in view of the principles of social function of rural property and dignity of the human being, from the perspective of the Tridimensional Theory of Law of Miguel Reale. |

O desrespeito aos direitos do trabalhador do campo tem-se perpetuado através dos tempos. Somente com a promulgação da Constituição da República de 1988, trabalhadores urbanos e rurais tiveram tratamento legal igualitário. O trabalho escravo que esteve presente por mais de trezentos anos da história do Brasil, ainda se perpetua por intermédio de práticas de trabalho análogas às de escravo. A chegada das relações capitalistas de trabalho ao meio rural constituiu mais um agravante na condição do trabalhador rural. Relação de emprego é uma das espécies de relações de trabalho, e, para melhor contextualizá-la como forma de prestação de serviços subordinada, distinta do trabalho autônomo e de outras formas subordinadas de prestação de serviços, descrevem-se o disciplinamento jurídico do contrato de emprego do rurícola e dessas outras formas de prestação de serviços. Nos últimos anos, duas leis foram editadas criando regras específicas para disciplinar o vínculo de emprego rural. Ambas decorrem do fato de que a demanda de mão-de-obra no campo, hoje, ocorre em determinadas fases da produção. O aumento de produtividade, decorrente da modernização das atividades agrárias, eleva a eficiência do sistema, contudo, reduz a geração de emprego. Não implica, necessariamente, aumento do número de postos de trabalho. Por isso, o maior problema enfrentado hoje, atinente ao emprego no campo, diz respeito ao empregado volante ou boia-fria. A Teoria Tridimensional do Direito de Miguel Reale vê o direito como uma integração normativa de fatos segundo valores. Permite uma análise elucidativa da problemática do rurícola empregado, com a verificação das condicionantes decorrentes do processo histórico e das decorrentes da reestruturação produtiva, para, em seguida, analisar-se a lei trabalhista compreendida em seu tríplice sentido: fato, valor e norma, à luz dos princípios constitucionais da função social do imóvel rural e da dignidade da pessoa humana. Ao final, conclui-se que a questão do emprego no campo extrapola o âmbito trabalhista. Depende de mudanças culturais e de alteração na distribuição fundiária. Sem uma visão do empregado enquanto ser humano digno, o que implica o cumprimento da função social do imóvel rural, e sem uma melhor distribuição da terra, não se resolverá a questão do rurícola empregado. Por último, são abordadas as perspectivas que se apresentam para o trabalhador rurícola empregado, em Goiás. A dissertação estrutura-se em três capítulos. O primeiro, no qual se faz um relato da história do Brasil e de Goiás e um estudo dos meios de produção no desenrolar desse período histórico. O segundo, em que são caracterizadas as formas de prestação de serviços -autônoma e subordinada- e descrito o tratamento jurídicolegal dado ao dispêndio da força de trabalho, sob as diversas formas em que se apresenta, com enfoque preponderante no trabalho do empregado rural. O terceiro, em que é analisada a situação do trabalhador rural, especialmente do empregado rural no Estado de Goiás, tendo em vista os princípios da função social do imóvel rural e da dignidade da pessoa humana, sob a ótica da Teoria Tridimensional do Direito de Miguel Reale.Made available in DSpace on 2014-07-29T15:25:11Z (GMT).
