ANÁLISE JURÍDICA DA CERTIFICAÇÃO DE ALIMENTOS ORGÂNICOS DE PROJETOS DE ASSENTAMENTO DE REFORMA AGRÁRIA

Resumo: The research starts from the vision of agrarian reform as a public policy for the reorganization of the Brazilian land structure, regional development and social assistance to its beneficiary. It presents the family farmer, the main actor of public policy, and his relationship with the land, characteristics and peculiarities as a way of life, in a perspective of the instrumental freedom proposed by Amartya Sen. Identifies the importance of the production of products by the settlers for sustainability in an agricultural model that combines production efficiency and protection of the environment. And in this context, the objective is the legal analysis of the certification of derived foods in retirement settlements, seeking legal solutions to the difficulties encountered by settlers in obtaining them. The research concludes with the indication of certification by audit as the most appropriate method for organ certification, made possible by a government partnership that already has precedents, without detriment to the participatory guarantee system, which requires legislative changes for better implementation.Methodologically, the study uses a legal-sociological approach, adopts bibliographic, documentary and field research, and has an exploratory and descriptive approach. The method used is the deductive method.

A pesquisa parte da visão da reforma agrária como política pública de reorganização da estrutura fundiária brasileira, desenvolvimento regional e assistência social ao seu beneficiário. Apresenta o agricultor familiar, ator principal da política pública, e sua relação com a terra, características e peculiaridades como modo de vida, em uma perspectiva de liberdade instrumental proposta por Amartya Sen. Identifica a importância da produção de orgânicos pelos assentados para a sustentabilidade em um modelo de agricultura que alia eficiência da produção e proteção ao meio ambiente. E nesse contexto objetiva a análise jurídica da certificação dos alimentos orgânicos produzidos em assentamentos de reforma, visando buscar soluções jurídicas para as dificuldades encontradas pelos assentados na sua obtenção. Conclui a pesquisa com a indicação da certificação por auditoria como o método mais adequado para a certificação de orgânicos, viabilizada por parceria governamental que já detém precedentes, sem detrimento do sistema participativo de garantia, que requer alterações legislativas para melhor implementação. Metodologicamente, o estudo utiliza enfoque jurídico-sociológico, adota os meios bibliográfico, documental e a pesquisa de campo, e possui finalidade exploratória e descritiva.
