CAVALCANTI, Francisco Ivo Dantas, também é conhecido em citações bibliográficas por: DANTAS, Ivo.A tese examina o instituto do estado de coisas inconstitucional, de origem colombiana,com o intuito de investigar sua aplicabilidade à ordem constitucional brasileira pelo Supremo Tribunal Federal na solução da crise do sistema carcerário brasileiro. Para tanto, serão estudadas as omissões inconstitucionais, bem como as sentenças estruturais, dentre as quais se insere o estado de coisas inconstitucional. Serão estudados vários tipos de constitucionalismo para, ao fim, associar os conceitos de cooperação entre os poderes e o diálogo institucional como meios para a resolução de tais problemas.Por meio de pesquisa jurisprudencial, observado o método indutivo, identifica a origem remota dessa técnica decisória no direito estrangeiro, inclusive casos em que existem as sentenças estruturantes, ainda não denominadas de estado de coisas inconstitucional, passando, finalmente, ao estudo das decisões proferidas sobre a matéria pela Corte Constitucional colombiana, responsável por sua sistematização. Após, será analisada a incorporação da tese pela ordem constitucional, com o exame da decisão proferida pelo Supremo Tribunal Federal no julgamento da Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 347/DF. Estudam-se os pedidos formulados na ação, para, finalmente, fazer um esboço das perspectivas para o julgamento definitivo da ADPF nº 347/DF e conclui-se, em arremate da pesquisa empreendida, pela adequação da tese do estado de coisas inconstitucional à garantia da efetividade da Constituição brasileira, sempre com a cooperação e o diálogo institucional.The thesis examines the institute of the unconstitutional state of affairs, of Colombian origin, in order to investigate its applicability to the Brazilian constitutional order by the Supreme Federal Court in the solution of the crisis of the Brazilian prison system. In order to do so, the unconstitutional omissions will be studied, as well as the structural sentences, among which the unconstitutional state of affairs is inserted. Several types of constitutionalism will be studied in order to associate the concepts of cooperation between the powers and the institutional dialogue as a means of resolving such problems. By means of jurisprudential research, observing the inductive method, it identifies the remote origin of this decision technique in foreign law, including cases where there are structural injuctions, not yet denominated as unconstitutional state of affairs, passing, finally, to the study of the decisions made by the Colombian Constitutional Court, responsible for its systematization. After that, the incorporation of the thesis will be analyzed by the constitutional order, with the examination of the decision handed down by the Supreme Court in the judgment of the misfulfillment of ADPF No. 347/DF.
