Contemporary society has been presenting profound changes, which are starting to create a scenario of uncertainties, economic, political, social and environmental crises. In this context, we must turn to those fundamental rights that form the guiding thread of our existence, and thus find possible ways to consecrate these rights, to quote them: Right to life, Right to health and Right to the healthy environment and balanced. Based on this premise seek an improvement in the quality of life of individuals guided by the changes of thought, through new challenges imposed on the contemporary state and society. By means of a historical and philosophical study of modern and postmodern juridical thinking, addressing issues that confront current environmental degradation with the (liberal) political project, and thus analyze these phenomena from a collective and systemic perspective. For that, the deductive method of approach was used and the indirect documentation of secondary sources through bibliographical consultations, scientific articles, books and essays was used as research technique. Lastly, it is important to emphasize the adherence of this theme to the line of research on Sociobiodiversity and Sustainability Rights of the Graduate Program in Law of the Federal University of Santa Maria (UFSM), given the fact that an effort will be made to understand the formulation and implementation of public policies, within the framework of the Constitution of the Republic of 1988, in particular, the National Policy for Health Promotion - Ordinance no. 2,446 of November 11, 2014, which provides a better living condition for the population and safeguards the balance of the environment through ways that may serve to protect this right.
