Resumo: | I n this research we chose to understand the historical course of the exploitation of slave-like labor and the legal tools of combat in Brazil today. The objective is to understand the lines of exploitation through slave labor and its influence on the construction of Brazil. ILO Conventions 29 and 105, the Universal Declaration of Human Rights, the San Jose Costa Rica Pact, the Protocol of San Salvador and the 1988 Federal Constitution, the Consolidation of Labor Laws, the Penal Code, among others. The study investigated, as a general objective, the analysis of the historical course of slavery in the world to the present day in Brazil and, as specific objectives, the practice of slave labor since the dawn of human existence, including the slave traffic in colonization of continents, the violence committed against the enslaved, the abolition of slavery, the slave-like work existing in Brazil today and the current legal support, the presence of migrants and immigrants in this context and the rural and urban contexts of Brazil where this practice is blatant and the related statistical aspects. It is justified by the timeliness and importance of the theme, as the flagrant work of slave labor is frequent, mainly due to the territorial extension of Brazil and the insufficient amount of Labor Auditors for proper supervision, despite the current regulatory framework. The research was developed from the hypothetical-deductive approach method. The method of procedure used was the observational method combined with the comparative method and the monographic method, linking to the foundations of Marxist historical materialism. The adopted techniques were fact sheets, summaries and expanded summaries and the bibliographic revision used doctrine and legislation, with qualitative and quantitative approach. It concluded that the current legislation is not an obstacle to the practice of forced and degrading labor and that there are several productive systems that benefit from the exploitation of human labor through analogous work to the slave. Thus, it is necessary to strengthen the supervisory structure, combat migrant trafficking, invest in education and provide decent jobs. |

O objetivo é compreender os liames da exploração através do trabalho escravo e a sua influência na construção do Brasil. São referenciais legais internacionais as Convenções da OIT de números 29 e 105, a Declaração Universal dos Direitos Humanos, o pacto São José da Costa Rica, o Protocolo de São Salvador e, nacionais, a Constituição Federal de 1988, a Consolidação das Leis Trabalhistas, o Código Penal, dentre outros. O estudo averiguou, como objetivo geral, a análise do percurso histórico da escravidão no mundo até os dias de hoje no Brasil e, como objetivos específicos, a prática do trabalho escravo desde os primórdios da existência da humanidade, passando pelo tráfico de escravos na colonização de continentes, pela violência cometida contra os escravizados, a abolição da escravatura, o trabalho análogo ao de escravo existente no Brasil hoje e o aporte legal vigente, a presença de migrantes e de imigrantes nesse contexto e os contextos rurais e urbanos do Brasil onde essa prática é flagrante e os referentes aspectos estatísticos. Justifica-se pela atualidade e importância do tema, pois são frequentes os flagrantes de trabalho análogo ao de escravo muito em função da extensão territorial do Brasil e da insuficiente quantidade de Auditores-Fiscais do trabalho para a devida fiscalização, apesar do arcabouço regulatório vigente. A pesquisa foi desenvolvida a partir do método de abordagem hipotético-dedutivo. O método de procedimento utilizado foi o observacional combinado com o método comparativo e com o método monográfico, vinculando-se às bases do materialismo histórico marxista. As técnicas adotadas foram fichamentos, resumos e resumos expandidos e a revisão bibliográfica utilizou doutrina e legislação, com abordagem qualitativa e quantitativa. Constatou-se que a legislação vigente não é óbice para a prática de trabalho forçado e degradante e que diversos são os sistemas produtivos que se beneficiam da exploração do trabalho humano através do trabalho análogo ao de escravo.
