Resumo: This paper starts with a discussion of theoretical assumptions related to the theme to be developed: a discussion of the judiciary, the service court and the tendency of \"exaltation\" of judicial precedent as a legal source, implies a necessary overview of the classical school the right of common law and civil law, which are constantly submerged in a mutual process of convergence, the result of man\'s search for a society and socio-legal system more secure, efficient, quick and in the end, just. Thus, in the first part of this paper, we will weave this author held a discussion on the history and construction of the family of common law and civil law, starting with the first, so that some assumptions are set for the subsequent analysis . Even Start, will highlight the formation, structure, sources and key milestones such schools legal categorization, brief comparison between the main countries that have adopted one or another system, etc. Enter will be still a more accurate reflection of the influence brought about by the common law and how that immanence has been reflected on the jurisdictional activity practiced by the judiciary in Brazil, especially with regard to the hereafter \"verticalization of the jurisdiction , \"described as the motion of granting increasing powers and duties of the higher courts, often at the expense of functional autonomy and freedom of conscience tyrannical courts and lower level. More than that, it is objective of this paper to trace some of the inevitable reactions found in the legal vertical to that, sometimes to the benefit, sometimes to the detriment of the protection of fundamental rights. Parallel to this, even by way of introduction, there is no way to move away from some institutions and principles, which were and are of fundamental importance for the analysis of judicial power, articulated by thinkers and jurists who have greatly contributed to the construction of the history of man , society and the state itself, such as Montesquieu and Hans Kelsen, who contributed greatly to the dissemination of the discussion of the theory of \"tripartition of powers\" and \"legal positivism\", respectively, issues inextricably linked to the evolution of judicial power. In the middle of the road ahead will be treated part of the legal and procedural tools created over the last decades (some of questionable constitutionality), all with the ultimate goal of making the process less bureaucratic and more quickly, giving almost absolute judicial source effects. This trend has noble foundations, as now cited, however, the proposed means for achieving these goals is open to criticism. This point is of crucial importance for the conclusions reached by this work. From this perspective, we pass by the analysis (albeit with aim of example) of comparative law, telling the paper that the case law has had in jurisdictions such as Portuguese, Italian, among others, when effectively achieve the tools and positions taken by the higher courts in Brazil, which have represented the \"government\" of the case law in the construction of state and society, with a marked increase in regulatory activity. In the final analysis, to allocate a very controversial issue: the overcoming of the foregoing, translated into face-law and the effects that such conduct may result in court, especially in a frank context of law and judicialization of preponderance of the right precedent. So, you want the job go a little further than the mere observation of the influence of the thought of the last bodies from the judiciary, as it raises demonstrate the necessary caution with which the evolution should be treated, lest it be in Indeed, back in the constitutional function of the state of social peace, the great part played by the judiciary. At the end, considerations about the process of overcoming the legal precedents are measured and their effects (beneficial or not) to the daily life of jurisdictions, as well as an opportunity to talk about legal certainty and good faith of the Government, as well as fundamental rights the citizen. By way of a preliminary conclusion, the author brings some reflections on the problems raised, whose highest aim is not to exhaustion, but that foster discussion, so that the same moose new heights.

By way of a preliminary conclusion, the author brings some reflections on the problems raised, whose highest aim is not to exhaustion, but that foster discussion, so that the same moose new heights.O presente trabalho é iniciado com uma abordagem dos pressupostos teóricos relacionados ao tema a ser desenvolvido: discorrer sobre o Poder Judiciário, a prestação do serviço jurisdicional e a tendência de exaltação dos precedentes jurisdicionais como fonte jurídica, implica numa necessária visão panorâmica das clássicas escolas do direito da common law e da civil law, as quais se encontram submergidas num incessante processo de convergência mútua, fruto da busca do homem e da sociedade por um sistema sócio-jurídico mais seguro, eficiente, célere e, ao fim, justo. Assim, na primeira parte do presente trabalho, o objetivo deste autor será tecer uma detida reflexão sobre a história e construção das família da common law e da civil law, iniciando-se pela primeira, a fim de que sejam fixadas algumas premissas da posterior análise. Ainda de início, serão ressaltadas a formação, a estrutura, as fontes e os principais marcos de tais escolas jurídicas, categorização, breve comparativo entre os principais países que adotaram um ou outro sistema, etc. Adentrar-se-á ainda a uma reflexão mais apurada acerca da influência trazida pela common law e de que forma tal imanência tem se refletido sobre a atividade jurisdicional praticada pelo Poder Judiciário no Brasil, principalmente no que diz respeito à aqui denominada verticalização da jurisdição , assim descrito o movimento de outorga cada vez maior de poderes e atribuições aos órgãos jurisdicionais superiores, muitas vezes em detrimento da autonomia funcional e livre consciência dos tribunais e órgãos monocráticos de menor escalão. Mais do que isso, faz-se objetivo da presente dissertação traçar algumas das inevitáveis reações constatadas no meio jurídico à referida verticalização, ora em benefício, ora em prejuízo da tutela dos direitos fundamentais. Paralelo a isso, ainda à guisa de intróito, não há como se afastar de alguns institutos e princípios, que foram e são de fundamental importância para a análise da fonte jurisprudencial, articulados por pensadores e juristas que muito contribuíram para a construção da história do homem, da sociedade e do próprio Estado, tais como Montesquieu e Hans Kelsen, os quais contribuíram sobremodo para a divulgação do debate da teoria da tripartição dos poderes e do positivismo jurídico , respectivamente, temas intrinsecamente ligados à evolução da fonte jurisprudencial. Em meio ao caminho a ser percorrido, serão tratados parte dos instrumentos jurídico-processuais criados ao longo das últimas décadas (alguns de constitucionalidade questionável)1, todos com finalidade última de tornar o processo menos burocrático e mais célere, conferindo à fonte jurisprudencial quase que absolutos efeitos. Tal tendência possui nobres fundamentos, como os agora citados; entretanto, os meios propostos para o alcance de referidos objetivos é criticável. Tal ponto será de crucial relevância para as conclusões chegadas pelo presente trabalho. Sob esta perspectiva, passaremos pela análise (ainda que com fito meramente exemplificativo) do direito comparado, informando o papel que a jurisprudência tem exercido em ordenamentos como o português, o italiano, dentre outros, quando efetivamente alcançaremos os instrumentos e posições adotadas pelos tribunais superiores no Brasil, os quais têm representado o governo da jurisprudência na construção do Estado e da sociedade, com o sensível aumento de sua atividade normativa. Em análise final, aloca-se um tema deveras controverso: a superação dos precedentes, traduzida em viradas jurisprudenciais e os efeitos que tais condutas jurisdicionais podem ocasionar, sobretudo num contexto de franca judicialização do direito e de preponderância do direito sumular. Assim, pretende o trabalho ir um pouco além do que a mera constatação da crescente influência do pensamento proveniente das derradeiras instâncias do Judiciário, na medida em que enseja demonstrar a necessária cautela com a qual a evolução deve ser tratada, sob pena se estar, em verdade, regredindo a função constitucional do Estado de pacificação social, em sua grande parte desempenhada pelo Poder Judiciário. Ao termo, considerações sobre o processo de superação dos precedentes judiciais serão dosados, bem como seus efeitos (benéficos ou não) ao cotidiano do jurisdicionado, oportunidade em que bem se falará sobre segurança jurídica e boa-fé do Poder Público, também enquanto direitos fundamentais do cidadão.
