Resumo: Food hygiene safety is a challenge to industry, regulatory agencies and consumers. Studies to evaluate enforcement of legislation on consumers level are necessary as well as the performance of the agencies. In this study the implementation of some food safety regulations was evaluated in the Ubá-MG Brazil area. First an in depth review of Brazilian food legislation was conducted, namely Decree-law 986/1969, Health Ministry Acts 1428/1993 and 326/1997, Food Agency (ANVISA) Acts 275/2002 and 216/2004, Agriculture Ministry Acts 368/1997 and 46/1998. General Principles of Food Hygiene from Codex Alimentarius was also thoroughly consulted. It was verified that, the three contacted hospitals did not possess records of notifications of any cases and, or food outbreak diseases during the period from 2004 to 2007. Among the 17 municipalities visited, eight (47.0%) of them had the presence of VISA sector, for monitoring of the Food sector, being accomplished by a total of 26 employees. From this sample of employees, it was found that 38.5% had completed an undergraduate program, and 23.1% possessed specialization in food production. Activities with educational goals are reached in 50.0% of the municipalities. Municipalities that fail to reach inspection objectives actively perform inspections, however, inefficiently. In six Health Departments (75.0%) is considered the preventive focus for the accomplishment of the activities. It was verified that five (62.5%) establishments judge it as extremely important and necessary, and three establishments think that it is very important and necessary. Among these establishments, not necessarily in the same town, 62.5% claim that the food laws are not known by the employees in food establishments. Twenty one food market establishments were visited, a large percentage were butcher shops (33.3%), followed by bakeries (23.8%) and grocery stores (19.0%). Other visited establishments included, restaurants, snack bars and fruit vendors (23.9%). Of these visited establishments none possessed a certified technical food quality representative. Only four establishments (19.0%) have the sanitary certification issued by Sanitary authority, and the remaining establishments, 81.0%, have the certification issued by the city hall. All of the employees interviewed had a response indicating that the VISA sector does not assist them with relevant information necessary to perform their jobs in a sanitary manner. Among these employees, 57.1% work in towns where there is no such sector. It was observed that 81.0% of the establishments do not follow the laws set by The Brazilian Legislation for Food. Of the interviewed employees, 90.5% think that the implementation of such laws in food establishments is very important and necessary. However, it was also found that a significant number of the employees interviewed did not have sufficient knowledge of the food legislation. This research shows that few food establishments follow current legislation. In regards to the two food industries visited, it was noticed that they follow the current food legislation. In conclusion, presently there is no efficient implementation or enforcement of the food legislation in food establishments studied in the region. Therefore, food trade is accomplished without proper monitoring and sanitary precautions. Moreover, most people involved in the food establishments, restaurants, markets, etc., are not aware of the Brazilian food legislation and regulations. This evidence suggests that it is imperative for action to be taken to educate people dealing with food products of the dangers that unsanitary practices can pose to consumers.

This evidence suggests that it is imperative for action to be taken to educate people dealing with food products of the dangers that unsanitary practices can pose to consumers.Aumentar a segurança e a qualidade dos alimentos produzidos, a fim de atender as exigências dos consumidores locais e de países importadores, como garantir a proteção a sua saúde, é um dos grandes desafios tanto das indústrias como dos Estados e dos órgãos de regulação. Neste sentido, fazem-se necessários estudos que avaliem a implementação dos instrumentos normativos estabelecidos pela legislação brasileira de alimentos nos estabelecimentos alimentícios, como também a atuação dos órgãos fiscalizadores. Sendo assim, o objetivo do presente trabalho foi realizar uma descrição das principais normas relacionadas à higiene dos alimentos, como também conduzir uma análise qualitativa, para verificação ao atendimento a tais normas na Microrregião de Ubá-MG. Para tal, realizou-se uma pesquisa com levantamento bibliográfico sobre os principais aspectos de higiene abordados pela ANVISA, pelo MAPA e pela Comissão do Codex Alimentarius; levantamento de dados em hospitais e também, visitas a Secretarias Municipais de Saúde, estabelecimentos e indústrias de alimentos. As normas descritas foram: Decreto-lei 986/1969, Portarias MS 1.428/1993 e 326/1997, Portarias MAPA 368/1997 e 46/1998, Resoluções RDC ANVISA 275/2002 e 216/2004 e Princípios Gerais de Higiene dos Alimentos do Codex Alimentarius. Verificou-se que, os três hospitais contatados, não possuíam registros de notificações de casos e, ou surtos de doenças de origem alimentar no período de 2004 a 2007. Dos 17 municípios visitados, constatou-se que em oito (47,0%) havia presença de um setor de VISA, para fiscalização do setor alimentício, sendo realizada por um total de 26 funcionários. Dentre estes, verificou-se que, 38,5% têm curso superior completo, sendo que 23,1% possuem especialização. Atividades com caráter educativo são realizadas em 50,0% dos municípios. Os demais realizam inspeção, mas não com esta finalidade. O enfoque preventivo é considerado para a realização das atividades em seis (75,0%) Secretarias Municipais de Saúde. Quanto à importância da implementação da legislação de alimentos nos estabelecimentos, verificou-se que cinco (62,5%) servidores julgam extremamente importante e necessária, enquanto três (37,5%) acham muito importante e necessária. Dentre estes, não necessariamente dos mesmos municípios, 62,5% disseram que as normas são desconhecidas pelos empregados do comércio de alimentos. Dos 21 estabelecimentos comerciais visitados, a maioria foram açougues (33,3%), seguidos por padarias (23,8%) e mercearias (19,0%). Os demais estabelecimentos foram restaurantes, lanchonetes e sacolão de frutas e verduras (23,9%). Nenhum destes possuía responsável técnico. Apenas quatro (19,0%) estabelecimentos têm alvará sanitário emitido pela Secretaria de Vigilância Sanitária, sendo que os demais, 81,0%, possuem alvará de funcionamento emitido pela prefeitura. Todos os empregados questionados responderam que o setor de VISA não presta assistência com informações e ações educativas para capacitação dos empregados, sendo que 57,1% situam-se em municípios que não possuem tal setor. Observou-se que 81,0% dos estabelecimentos não seguem as normas estabelecidas pela legislação brasileira de alimentos. Dentre os entrevistados, 90,5% julgaram a implantação de tais normas nos estabelecimentos, como muito importante e necessária, porém verificou-se que a maioria das opiniões foi dada sem o conhecimento da legislação. As observações feitas, durante a aplicação do questionário, sobre as condições higiênico-sanitárias nos estabelecimentos, mostraram que poucos seguem os itens preconizados pela legislação. Quanto às duas indústrias visitadas, constatou-se que as mesmas estavam em conformidade com as Portarias referidas. Concluiu-se, que não há implementação efetiva das ações de Vigilância Sanitária no setor alimentício da região estudada, portanto a comercialização dos alimentos é realizada sem controle eficiente e segurança.
