The construction of the Municipal Council Health in Brazil as participatory spaces in the public policy agenda can be considered one of the major conquests of civil society in national democracy. The councils were legitimized with the Federal Constitution of 1988 which allowed the participation of society in the management of health and the law 8142 1990 establishing health advice, plus the Resolution 333 of 2003 with the main referrals to the organization and functioning of the boards of health. Regarding the democratic model, this participatory space approach of the precepts of the deliberative models of democracy, where the discourse between those involved in the process is the main decision making tool. Based on these facts, from the aspects that allocate the advice as the members present at the health system and the rules governing the functioning of this institution agenda, the Municipal Council Health of Belo Horizonte is fulfilling its duties set normatively? To answer this central research question, three articles were built. In the first, was transcribed the creation of the board of health and the rules governing it, as well as the democratic model which comes closest. Then, based on content analysis, discussed the functioning of the board from the minutes of the plenary. The latter addresses the perception of officers in relation to the board of health and its role. Besides the three proposed articles are presented introduction to the general conclusions of the study.
