This research seeks to contribute to a critical analysis on the production of low-income housing in mid-sized cities between the years 1999 through 2008. The research focuses on housing policy in Brazil after the 1988 Federal Constitution, with emphasis on the role of municipalities and the new financing programs that allows the articulation with the private sector for the production of low-income housing, particularly those that use resources from Residential Leasing Program (PAR) of the Caixa Econômica Federal, established in 1999 by the Federal Government. Based on case study of Presidente Prudente, a city located west of Sao Paulo State, we discuss the relationship between the urban and housing policies and implementation of residential developments for low income through private enterprise, its mechanisms and effects on municipal territory. It starts from the assumption that the PAR signaled new opportunities for financing lowincome housing for the city in partnership with the private sector, and urban policy, especially the Urban Master Plan and its instruments, should guide the action of agents on behalf of a balanced urban development, not excluding. In the case of Presidente Prudente, the absence of an urban policy with clear guidelines for housing policy contributes to a direct action of private capital, which contributes to the production of exclusive and segregated spaces. For this, the research presents the trajectory of housing policy in Brazil, the local public actions in Presidente Prudente aimed to produce social housing and municipal laws that support or control this production. We discuss the principles of formulation and institution of PAR nationwide, and the insertion of Presidente Prudente in the program. Five enterprises with federal funding are created, seeking regularization in the municipal guidelines for controling of urban space, and compared to existing municipal regulations in Presidente Prudente. The basis of the analysis is the freedom of action that the local government allows to the private sector. We conclude that for the production of a more fair and equitable, the municipal urban and housing policy must be reviewed, in a articulate way, with proper guidelines and based in the local reality, allowing the use of inclusive urban planning instruments
