Hydrological disasters, because human and material losses, can be considered one of the greatest problems facing societies today, especially because of their frequency and intensity. Whereas the legal interests harmed because of the occurrence of this type of disaster, it is necessary to reflect on the possibilities and limits of legal and extra-legal instruments capable of providing protection of the community in the face of such disasters. It can be stated that emerges and establishes itself a fundamental right to protection against disasters, which requires positive action by the state and the whole society in the search for effective protection, among others, the right to dignity. In this perspective, growth-related risk areas, development of cities and resilience issues, as well as on the role of the federal (and, in particular, municipalities) in disaster protection entities, by implementing and encouraging preventive public policies were discussed with the aim of analyzing the possibilities to ensure the effective protection of this fundamental right. It has been argued in this thesis not only the emergence but also the dedication of the "Law of protection against disasters", fundamental human right that must be protected according to the principles and fundamentals that govern the protection of fundamental rights. For this, we promoted the study of factors that contribute to the occurrence of disasters and ratings attached to them, for, after analyzing up hydrological disasters from the viewpoint of fundamental rights, if inquiring about - their characteristics and rights correlated, as well as public policies related to protection against such disasters. Thus, the study concluded that establishment of a fundamental right to protection from disasters, whose accomplishment calls for a proactive role of the government as a public entity, supervising and promoting protectionist policies and planning actions to mitigate disaster risks, especially in the areas of risk. Similarly, the study identified a need for greater involvement and public engagement towards the promotion and enforcement of citizens and participatory activities, dedicated to the protection of this right, in partnership with government and other stakeholders.
