Resumo: The present study aims to further elaboration on the issue of State Theory and its deficit in Regulation theory initially developed by the French regulacionists, and then analyze the relevance of the use of the theory of Regulation as a method of analysis of the State and Law. As basis will be used two authors who use the Theory of Regulation as one of the basis for their respective theories. They are Bob Jessop from English critical realism and Joachim Hirsch who follows the German derivacionism. This will be able to verify what level of deepening the analysis of the Theory of Regulation within the framework of the State and Law, both in current capitalism analysis, as for the proposition of solutions for overcoming the capitalist model.

São eles Bob Jessop proveniente do realismo critico inglês e Joachim Hirsch que segue a corrente do derivacionismo alemão.
