Resumo em Inglês: The present study focuses on women’s guarantees of a humanized birth process, which assures the presence of a companion of her choice for birth process, in public and private hospitals, as demanded in law – Law 11.108/2005 – Companion Law. The purpose of this study was to identify if mothers had knowledge about the Companion Law and if this law is being effective through the phases of birth process – pre-birth, birth and post-birth, and to comprehend the benefits and harms of the companion’s presence. Considering all ethic care, a qualitative research took place, through semi-structured interviews with twelve volunteers in two different age groups (18 to 25 years old and 26 to 40 years old). After analysis, it was concluded that the results provide a better understanding of the importance of a companion in the birth process, identifying that despite the lack and misinformation about the Law of the Companion, it was respected and honored by the majority of pregnant women in the birth process. It also reiterated the importance of a companion in labor and birth process, strengthening scientific evidence that corroborated the reports pointing benefits monitoring, which must be encouraged and never denied to women. It was concluded that the implementation of the Companion Law still needs improvement, as it is still deficient. However, it has shown effectiveness, once there was no impediment to the exercise of this right except for a woman. It was concluded that the implementation of the Companion Law still needs improvement, as it is still deficient, being more realized at the birth process, but not in the post-birth, when it is not guaranteed the entry of male companions at any time in the accommodation.

Os objetivos propostos foram identificar se as gestantes possuíam conhecimento a respeito da Lei do Acompanhante e se esta era efetivada nas etapas pré-natal, parto e pós-parto; e compreender a importância da garantia do/a acompanhante no trabalho de pré-parto, parto e pós-parto, na visão de parturientes, para compreender os benefícios e/ou malefícios da presença do/a acompanhante para a parturiente. Considerando os cuidados éticos, foi realizada pesquisa qualitativa, por meio de entrevistas semiestruturadas com 12 puérperas voluntárias de duas faixas etárias distintas (18 e 25 anos e 26 a 40 anos). Após análise dos dados, os resultados proporcionaram melhor compreensão da importância do/a acompanhante no processo de parto para parturiente, identificando que, apesar do desconhecimento e/ou desinformação sobre a Lei do Acompanhante, esta foi respeitada e efetivada junto à maioria das parturientes no momento do parto. Ratificou-se também a importância do/a acompanhante no processo de parto e nascimento, fortalecendo as evidências científicas, em que os relatos corroboraram apontando benefícios no acompanhamento, devendo este ser estimulado e jamais negado à mulher.
