Resumo: This thesis aims to discuss the production of truth in criminal proceedings beyond the epistemic excess that characterizes the correspondence theory of truth. Having postulated this initial premise, the thesis deals with a set of questions concerning the structure of the cognitive process, in order to properly consider its inherent complexity, breaking with a tradition of violent and monologic construction of knowledge and the imposition of the truth. With this purpose, we employ a significant number traditions (accusatory tradition, history of ideas, hermeneutics, the science of complexity and uncertainty) and conclude that the truth in the criminal proceedings is analogically produced, through a narrative that employs tracks of the pastness, which means that the truth is something contingent, showing above all the need to focus on the game rules of the due process of law
