The elderly population of Brazil has been presenting a pictgure of quick growth, calling the attention of society and public power to their necessities and demands. On the other hand, the precarious financial conditions of great part of these people do not allow a better quality of life having so, a considerable repercussion in their health condition. In turn, the health system focused on this population segment is not answering the purpose of the National Health Policy for the Elderly in defining the importance of a healthy and active ageing, especially when directed at people of low income. On the other hand, the programs of leisure implemented for the elderly, are not always answering the poorest people that assembly their own strategies to meet their needs in this área. Aiming to assess the obstacles to be overcome by the elderly in the exercise of their citizenship, in their demanda for recreation and health, we seek to identify the conditions and regularities of the practice of leisure and this relation with the health conditions of the actors studied. Our hypothesis is that despite the enactment of a significant legal-institutional contribution (laws and statute), the elderly not yet assumed their status of citizen, enjoying social rights, health and leisure guaranteed in the legislation. The descriptive study with quantitative data, is the result of a survey starting from the registration of 98 participants, of both sexes, coming from the Health Promotion Project of the Center of Attention to the Elderly, developed by Universidade da Terceira Idade at Universidade do Rio de Janeiro UnATI/UERJ, registered in the period that goes from 2000 to 2005, residents in the Tijuca, Vila Isabel, Maracanã, Grajaú and Andaraí neighborhoods, that compose the Reference Área (AR 2).
