Resumo: For many years the public authorities have been facing difficulties to order the interstate and international passenger transportation sector in Brazil, in particular to increase competition, reduce market concentration and expand and improve the quality of these essential pubic services. On the eve of the largest public tender in the sector, in 2014, a major overhaul of the sector was proposed by lawmakers, with a new regulatory model to liberalize interstate and international transportation services as a solution to overcome entry barriers, hindrances to competition and “straight jacket” regulations. This led to authorization of new players for the provision of interstate and international bus services. The objective of this work is to examine the past and present challenges faced in the search for a suitable regulatory model for the bus transport sector under the authority of the federal government, including a critical evaluation of a new regulatory framework. In this respect, the focus is on deregulation of the sector, describing the objectives that should be pursued and the instruments that should be adopted, in light of past failings, and also drawing parallels with other sectors and markets. In the end, some proposals are presented to improve the rules under a new regulatory framework, so as to optimize competition.

Às vésperas da maior licitação já planejada para o setor, foi proposta, em 2014, uma grade reforma setorial, com a apresentação de um novo modelo regulatório pelo legislador, que previu a liberalização dos serviços de transporte internacional e interestadual de longa distância como solução para contornar as barreiras à entrada, os entraves à concorrência e o “engessamento” da regulação — termo impresso na própria justificação da novel disposição legal. Instituiu-se, assim, a autorização dos serviços de transporte rodoviário interestadual e internacional de passageiros. O objetivo deste trabalho é de examinar os desafios passados e presentes enfrentados na busca de um modelo regulatório adequado para o setor de transporte rodoviário de passageiros da órbita da União, realizando uma avaliação crítica do novo marco regulatório. Pretende-se, nesse sentido, tratar da possibilidade da desregulação do setor, expondo os objetivos que devem ser perseguidos e os instrumentos que devem ser adotados, à luz das falhas passadas e, também, do paralelo com outros setores e mercados para, ao final, apresentar propostas voltadas a aprimorar as regras e o novo marco regulatório, na busca de um modelo ótimo de description For many years the public authorities have been facing difficulties to order the interstate and international passenger transportation sector in Brazil, in particular to increase competition, reduce market concentration and expand and improve the quality of these essential pubic services. On the eve of the largest public tender in the sector, in 2014, a major overhaul of the sector was proposed by lawmakers, with a new regulatory model to liberalize interstate and international transportation services as a solution to overcome entry barriers, hindrances to competition and “straight jacket” regulations. This led to authorization of new players for the provision of interstate and international bus services. The objective of this work is to examine the past and present challenges faced in the search for a suitable regulatory model for the bus transport sector under the authority of the federal government, including a critical evaluation of a new regulatory framework. In this respect, the focus is on deregulation of the sector, describing the objectives that should be pursued and the instruments that should be adopted, in light of past failings, and also drawing parallels with other sectors and markets. In the end, some proposals are presented to improve the rules under a new regulatory framework, so as to optimize competition.
