A Teoria da Burocracia em Nível de Rua também será abordada, já que são os agentes burocratas que executam as políticas; logo, estes devem ter conhecimento máximo para que as políticas públicas não sejam distorcidas. Assim, surge o seguinte questionamento: por que os magistrados não seguem os critérios dispostos na Lei 13.058/2014 em suas decisões? A hipótese é que os operadores de direito levam em conta seus princípios, crenças e convicções pessoais, ao passo que, muitas vezes ferem o princípio da imparcialidade o que dificulta a efetivação da Lei 13.058/2014 que disciplina acerca do instituto da guarda compartilhada. Para tanto, a presente investigação objetiva analisar o papel do sistema judiciário na solução dos conflitos familiares, definição de guarda e responsabilidades dos filhos e relacionar as estimativas do judiciário no que se refere às decisões de guarda compartilhada. A metodologia utilizada foi a qualitativa, por meio de entrevistas semiestruturadas foram entrevistados 15 advogados e 5 magistrados atuantes nas Varas de Família dos Municípios de Rio Grande,Pelotas e Santa Vitória do Palmar, para analisar de forma qualitativa os apoiadores e contrários à guarda compartilhada. Sendo confirmado que, embora os julgadores analisem as provas e tenham consciência da Lei, ainda assim, as suas convicções pessoais têm mais peso, e eles acabam não aplicando o que é definindo como regra na Lei 13.058/2014 em suas decisões.This paper will address parental alienation, relating it to shared custody, a modality that proves to be more effective in the fight against acts of parental alienation, as the time spent with both parents will be balanced, thus ensuring the fundamental right to family life which is extremely important for the development of children and teenagers.Furthermore, the Theory of Bureaucracy at Street Level Will be addressed, since bureaucratic agents are responsible for executing policies, and thus, they must have maximum knowledge so that public policies are not distorted.Therefore, a question arises:why magistrates do not follow the criteria set out in Law 13.058/2014 in their decisions? The hypothesis is that these legal practitioners take into account their personal principles, beliefs and convictions, violating the principle of impartiality and then making it difficult to implement Law 13.058/2014, which regulates the institute of shared custody. Therefore, this investigation aims to analyze the role of the judiciary system in the solution of family conflicts, definition of custody and responsibilities of children and relate the estimates of the judiciary regarding the shared custody decisions. The methodology used was qualitative, through semi-structured interviews with 15 lawyers and 5 judges working in the Family Courts of Rio Grande, Pelotas and Santa Vitória do Palmar. The objective was to analyze qualitatively the supporters and opponents of shared custody.
