A hierarquia social que impera é perpetrada por substantivas desigualdades. Neste sentido, e buscando reparar os males causados por equívocos históricos, o legislador pátrio evocou a figura da igualdade, como valor basilar da Carta Magna brasileira. Este trabalho tem como objetivo apresentar os elementos filosóficos e jurídicos, que estabelecem o Princípio Constitucional da Igualdade como base jurídica adequada ao estabelecimento de políticas afirmativas relacionadas ao negro no Brasil. Tomando como método de investigação e reflexão a hermenêutica inerente à lógica de Pierre Bourdieu, que evoca a Violência Simbólica como estabelecedora e legitimadora de matrizes culturais, busca-se clarificar, filosófica e juridicamente, a adequação da igualdade material como norteadora das ações e políticas afirmativas em prol da mitigação das desigualdades raciais no Brasil. Com efeito, infere-se que em um país cuja história é manchada por uma longa e dura escravatura, e no qual os afrodescendentes constituem a maioria da população pobre, e a grande maioria da população indigente; e que tal situação guarda relação com a imoralidade da desigualdade, o suporte filosófico reside em saber que a igualdade não vai emergir da simples coexistência dos indivíduos, e que as políticas e ações afirmativas são, de fato, justificáveis e coerentes, juridicamente, constituindo alternativa inteligente e mensurável, em favor da busca, em favor da igualdade, que faz-se remédio jurídico legítimo, em prol da justiça social.Slavery influenced Brazil's culture and social heritage, marking later social perceptions and practices that echo in the degraded work and the moral indifference of the elites with respect to the needs of the majority. The prevailing social hierarchy is perpetrated by substantive inequalities. In this sense, and seeking to redress the ills caused by historical mistakes, the national legislator evoked the figure of equality, as the basic value of the Brazilian Magna Carta. This paper aims to present the philosophical and legal elements that establish the Constitutional Principle of Equality as an adequate legal basis for the establishment of affirmative policies related to black people in Brazil. Taking as a method of investigation and reflection the inherent hermeneutics of Pierre Bourdieu's logic, which evokes Symbolic Violence as establishing and legitimizing cultural matrices, we seek to clarify, philosophically and legally, the adequacy of material equality as a guide for affirmative actions and policies. to mitigate racial inequalities in Brazil.
