Resumo: This dissertation aims to analize how little the dogmatic and formal education on Law, in force in Brazil since its creation in 1827, has evolved, when considered the constant transformation of the society. Considering as well that Law is a human phenomenon, including the Natural Rights, generated and exercised by humans. How the teaching of Law could be connected to the current social demands? Could the teaching of Law contribute to consolidate the exercise of citizenship and to decrease contest on peripheral ways? The solid structure of the teaching of Law based on a knowledge which is dogmatic, abstract and frequently divorced of the social context promotes the myth that the juridical system is able to answer all the questions of the society. It is possible to witness the estrangement and lack of preparation of the Law operators in face of complex contemporary social demands. This context has been called “the crisis of the teaching of the Law”, what in fact points to a wider crisis on several fields of knowledge. Considering the key point of this study, the teaching of Law should encourage the (new) bachelor to better exercise his capacity of deep thinking in order to face the social context critically, on a historical perspective, efficiently connecting Law and society, what would reflect in positive consequences to all. This study is reinforced by the ideal of justice pursued by the present society and the new paradigms of efficiency and functionality of the Law. In this scenario, it is required a qualitative advance in the teaching of Law. It is not only enough to change the way of teaching Law, it is necessary to change how Law is seen and learnt, what we believe is done by strengthening and deepening the study of propaedeutic disciplines like Theory of State, Sociology, Philosophy, among others disciplines which have been overridden in the school curriculum. Thus, the Law operator, on a wider and more participative social perspective, become more than a mere litigant agent, a multiplier of citizenship, helping to control the number of disputes in regions of poverty through dialogue and focus on the citizen. The present search is based on theoretical methodology, centred in revision of bibliography. The purpose of changing the paradigm of the teaching of Law implies results that only can be measured at mid and long term, requiring the continuation and amplification of this study. The research is conducted by the deductive method and the research technique applied was bibliographic.

The research is conducted by the deductive method and the research technique applied was bibliographic.O principal objetivo desta dissertação é analisar de que forma a educação jurídica formal e dogmática que vigora no Brasil desde sua criação em 1.827, pouco, ou quase nada evoluiu, frente a uma sociedade em plena ebulição e em constante transformação. Sem deixar de consignar que o Direito é na verdade um fenômeno humano - não desconhecendo os direitos ditos “naturais” - construído e exercido pelos homens. Daí, partimos para a indagação fundamental deste trabalho: como o ensino do Direito pode se conectar com as demandas sociais do presente? Pode o de ensino jurídico auxiliar na consolidação e exercício da plena cidadania? Contribuindo inclusive, para a diminuição de litígios nas vias periféricas? Diante do modelo solidificado de ensino jurídico centrado no conhecimento dogmático, abstrato e muitas das vezes, divorciado da realidade social, fomenta o mito de que o sistema jurídico tem respostas para todas as questões apresentadas pela sociedade, o que notadamente não reflete a realidade. Denota-se então, cada vez mais o distanciamento e despreparo dos operadores de Direito para solucionar a crescente complexidade das demandas sociais contemporâneas. Para nominar este contexto, adotou-se de forma genérica a expressão “crise do ensino jurídico”, o que nos parece, apenas parte de uma crise muito maior, que atinge todas as áreas do conhecimento. Justificando a escolha pelo tema central, o ensino jurídico deve ser capaz de proporcionar ao (novo) bacharel, maior profundidade no exercício de sua capacidade reflexiva, necessária ao enfrentamento da realidade social de forma crítica, sob uma perspectiva histórica, para possibilitar maior aproximação e diálogo entre a sociedade atual e o Direito, contribuindo para uma melhora na formação jurídica, importando em consequências positivas a toda sociedade. A pesquisa se mostra contextualizada diante do ideal de justiça perseguido pela atual sociedade e, frente aos novos paradigmas de eficiência e funcionalidade do Direito. Diante deste quadro, é salutar um salto qualitativo na formação jurídica. Não basta o incentivo à mudança na forma de ensinar o Direito, é necessário, antes de tudo, uma mudança na forma de enxergar e aprender o Direito, o que sob o nosso entendimento, se faz através do fortalecimento e aprofundamento nos estudos das matérias propedêuticas, como Teoria do Estado, Sociologia e Filosofia, entre outras, matérias que vêm perdendo espaço nos currículos escolares, para que o novo profissional do Direito, numa visão social mais ampla e participativa, seja muito além de mero agente litigante, um multiplicador de cidadania, notadamente contribuindo com a diminuição dos litígios nas regiões mais carentes através do diálogo e do enfoque no cidadão. A pesquisa realizada serviu-se de uma metodologia teórica, baseada na revisão bibliográfica. A proposta de mudança no paradigma do ensino jurídico, traz junto ao objeto de pesquisa, um resultado verificável a médio e longo prazo, cabendo a continuação permanente do referido estudo, que não pode permanecer restrito a este estudo.
