Resumo: | From concern to solution. Restlessness, because from the moment it came to my attention that adulteration of olive oil could be three times more profitable than selling cocaine, I realized that something unusual was happening, as, in fact, I found out. Solution, considering that I managed to find – with the help of technology and to the best of my judgement – means to detect those anomalies, providing everyone with a simple way to get to know the product better. The use of blockchain, AIoT (artificial intelligence of things), spectrometry and Artificial Intelligence will be essential to “potentiate” the principle of information, which despite being fundamental to the consumer relations,continues to be neglected, despite its legal obligation. It seems that much information that would be essential for the consumer does not even reach their knowledge, for example, the application of 24,996 fines by the Ministry of Agriculture (2018 to 2020) to manufacturers and producers who adulterated food products. Initially we visited questions of general interest related to food, and then pointed out constitutional and cultural aspects. In sequence, the differences between adulterated, altered and counterfeit foods will be analyzed with their various specificities. The most “adulterated” foods in Brazil and in the world were the subject of our investigation, with the aim of pointing out that this evil does not only plague us Brazilians, but the whole world. There will be a specific chapter for Transgenics and Spectrometry, with the intention of warning and informing that there are many truths that are far from the knowledge of the final recipient, as well as the possibility of using a tool that can help the consumer to detect present inconsistencies. The chapter on Technology takes the reader to countless possibilities that can be applied with this new technique, not only with regard to issues related to food, but to an exponential range of situations, highlighting Blockchain, AIoT and their ethical aspects. In continuity, we confront the consequences of adulteration, alteration and falsification in light of the Consumer Protection Code, demonstrating that the Principle Information is a standard of public order that is essential for consumer relations, and, with the help of technology, it will be better applied, including the insertion of the QR- CODE on product labels. As a final step, the criminal and administrative aspects relating to the hypotheses of adulteration, alteration and falsification of food. The originality of the work is present in the sense that upon finding so many inconsistencies in food, we indicate some possibilities to combat them. This can be done through the insertion of a QR-CODE in each product, using blockchain technology or even the application of artificial intelligence, enabling the consumer to relate to the product, as elsewhere demonstrated. These paths are solely intended to help the consumer so that once and for all compliance with the Information Principle can truly and finally bring clarity and adequacy, feelings so dear to everyone and which are achieved by consumer relations. |

Inquietação porque, a partir do momento em que chegou ao conhecimento do autor de que a adulteração de azeite de oliva poderia ser três vezes mais lucrativa que a venda de cocaína, logo se percebeu que algo incomum ocorre, como de fato foi descoberto. Solução, considerando-se que, s.m.j., conseguiu-se encontrar – com o auxílio da tecnologia – meios para detectar essas anomalias, o que proporciona a todos uma maneira simples de melhor conhecer o produto. O uso de blockchain, IoT (inteligência artificial das coisas), espectrometria e inteligência artificial (IA), será imprescindível para “potencializar” o Princípio da Informação, que, apesar de ser fundamental para a relação de consumo, continua a ser desprezado, em que pese a sua obrigatoriedade legal. Constata-se que muitas informações que seriam primordiais para o consumidor sequer chegam ao seu conhecimento, como, por exemplo, a aplicação de 24.996 multas pelo Ministério da Agricultura (2018 a 2020) a fabricantes e produtores que adulteraram produtos alimentícios. Inicialmente, foram visitadas questões de interesse geral relacionadas aos alimentos, para, em seguida, apontarem-se seus aspectos constitucionais e culturais. Na sequência, analisar-se-ão as diferenças entre alimentos adulterados, alterados e falsificados, com suas diversas especificidades. Os alimentos mais “adulterados” no Brasil e no mundo foram objeto de investigação, com o escopo de apontar que este mal não assola apenas os brasileiros, mas o mundo inteiro. Haverá capítulo específico para os Transgênicos e a Espectrometria, com a intenção de alertar e informar que existem muitas verdades que estão longe do conhecimento do destinatário, bem como a possibilidade de se utilizar uma ferramenta que pode auxiliar o consumidor a detectar inconsistências presentes. O capítulo sobre Tecnologia conduz o leitor a incontáveis possibilidades que podem ser aplicadas com essa novel técnica, não só no que tange às questões atinentes aos alimentos, mas a uma gama exponencial de situações, destacando-se Blockchain, IoT e seus aspectos éticos. Em continuidade, confrontam-se as consequências da adulteração, alteração e falsificação à luz do Código de Defesa do Consumidor (CDC), para demonstrar que o Princípio da Informação é norma de ordem pública e essencial para as relações de consumo, e, com o auxílio da tecnologia, ele será aplicado de modo melhor, inclusive, com a inserção do QR-CODE no rótulo dos produtos. Por fim, serão contemplados os aspectos penais e administrativos atinentes às hipóteses de adulteração, alteração e falsificação dos alimentos. O ineditismo do trabalho está presente, na medida em que, ao encontrar tantas inconsistências nos alimentos, indicam-se algumas possibilidades para o combate destas, que pode se dar através da inserção de QR-CODE em cada produto, valendo-se da tecnologia de blockchain, ou até mesmo a aplicação de IA, que possibilita que o consumidor converse com o produto, como alhures será demonstrado.
