Resumo: The aim of this paper is to study collective arbitration as a legally possible way to protect collective rights in the brazilian legal system and as a way to facilitate the protection of the rights of minority shareholders subject to the statutory arbitration clause. Therefore, it will be analyzed the classifications of collective rights as to their arbitrability, taking a new look at the criteria adopted to define arbitrable matters. Then, it will be drawn an overview of the United States' experience on the topic, analyzing how the class action in that country was reproduced in an arbitration proceeding. Subsequently, it will be examined the possibility of combining the collective procedure with the arbitration procedure in the brazilian legal system. Finally, a specific study will be done about the collective protection of the rights of minority shareholders, analyzing how collective arbitration can be a viable means of protecting collective rights in this category, and illustrating such analysis with an exposure of the recent case "In Re Petrobras Securities Litigation", which may become the first collective arbitration in Brazil

Para tanto, analisar-se-á as classificações de direitos coletivos quanto à sua arbitrabilidade, lançando um novo olhar sobre os critérios adotados para definir matérias arbitráveis. Em seguida, será traçado um panorama sobre a experiência dos Estados Unidos sobre o tema, analisando como a class action naquele país foi reproduzida em procedimento arbitral. Após, será examinada a possibilidade de combinação do procedimento de tutela coletiva com o procedimento arbitral no ordenamento jurídico brasileiro.
