Resumo: The present work is outlined in an incisive study on the general theories of judicial precedents, with study of the evolution of the institute, transposed to the Brazilian Law, analyzed from the prismatic point of legal security, verifying the relation between the two institutes and the limits one exercises on the other. By means of a critical analysis, the deficiencies of the Brazilian Civil Procedure Code in the systematic regulation of the system of jurisprudential law established by it and the institution of mandatory decisions and decision-making standards in relation to its concepts, regulations and the isolated procedures of application of each one of them in the process of judicial proceedings, always seeing from the point of view of the Federal Constitution, the mandatory decisions that actually have and those that may have mandatory effectiveness, regardless of the form of forecasting of the procedural system
