Resumo: The present study aims to examine the effetiveness of the ainti-discrimination public policy adopted by the state of São Paulo based on Law n. 10,948/2001 and n. 14,187/2010, based on the intertional protection of the human rights Against discrimination, as well as the constitutional protection of fundamental rights and freedoms. Law n. 10,948/2001 provide for administrative penalties applied to authors of offensive or discriminatory statements, motivated by sexual orientation or gender identity and Law n. 14,187/2010 establishes sanctions for discriminatory acts related to race or color. To analyze the effectiveness of these measures, data published in the annual reports of the São Paulo government will be observed, in the period between the years 2001 and 2024 (Law n. 10,948) and 2010 and 2024 (Law n. 14,187), considering the beginning of each one's validity. In addition, bibliographical and documentary research will be carried out in order to offer theoretical and empirical support to the investigation. Analysis of the data shows that discrimination due to sexual orientation or gender identity and race or color represents the majority of administrative processes initiated to investigate discriminatory acts within the scope of the public policy in question

A Lei n. 10.948/2001 dispõem sobre as penalidades administrativas aplicadas aos autores de manifestações atentatórias ou discriminatórias, motivadas por orientação sexual ou identidade de gênero e a Lei n. 14.187/2010 estabelece sanções por atos discriminatórios relacionados a raça ou cor. Para a análise da efetividade dessas medidas, serão observados os dados publicados nos relatórios anuais do governo paulista, no período compreendido entre os anos de 2001 e 2024 (Lei n. 10.948) e 2010 e 2024 (Lei n. 14.187), considerando o início da vigência de cada uma. Além disso, será realizada pesquisa bibliográfica e documental, de modo a oferecer suporte teórico e empírico à investigação.
