This paper proposes a critical reflection on the traditional conception of constituent power, which views it as a de facto and unlimited power from a legal perspective, especially in light of the antidemocratic risks that this classical understanding entails. In this sense, an analysis is made of the relationship, inevitable in contemporary constituent processes, between the democratic regime and the exercise of constituent power, aiming to highlight that this relationship is not always harmonious and that the traditional conception favors the occurrence of clashes between both institutes, in which democracy, most often, tends to emerge weakened and fragile. To illustrate and strengthen the theoretical arguments presented, two recent experiences in two Latin American countries were examined: Venezuela (1999) and Ecuador (2007-2008). In both instances, the processes of constitutional substitution were seized by the sitting presidents, who abused the extraordinary power associated with constituent power to attack the established powers, particularly the institutions responsible for state control, resulting in a decrease in the democratic quality of these countries. As the research methodology, a broad bibliographic review was conducted on the topics discussed, including monographs and articles by national and foreign authors. Specifically regarding the concrete cases analyzed, an examination was also carried out on the main normative acts that governed the respective Constituent Assemblies
